MCS B. Su- -LUS COMMODITIES 6. PERSONNEL We are returning to your office the copy of the Certificate of Award issued to Frank R. Skupa, an old age assistance recipient in Buffalo County. The original certificate issued is signed and acknowledged and is on file in the office of the Buffalo County Clerk. However, the lien is statutory and not dependent upon the signature or acknowledgment of the recipient. The statute takes the place of the formalities usually necessary to allow an instru- ment to be recorded. The only purpose of the Declarations of Ownership which were sent to enable you to record the certificates previously issued was to furnish a legal description of the real estate awned. Since the description appears on the face of the new certificate, we feel that it is unnecessary to attach the green forms. Section 68-261 C. S. Supp. 1939, which provides for the issu- ance of the certificate only requires that the name, age, residence, date of issuance, and amount be'stated. The lien statute provides that a copy of the certificate issued shall be indexed and recorded. We have submitted our procedure to the Attorney General and it has been approved by that office. With the above explanation we kindly request that the enclosed certificate be indexed and recorded against the real estate des- cribed. Thank you.
