<br />MAXIMUM LIEN. The lien of this Deed of Trust shall not exceed at any one time $45,000.00.
<br />THIS DEED OF TRUST is dated June 19, 2017, among Mendez Enterprises, LLC., whose
<br />address Is 2414 Sherman Blvd, Grand Island, NE 68803 -0000; A NEBRASKA LIMITED
<br />LIABILITY COMPANY ( "Trustor "); GREAT WESTERN BANK, whose address Is Holdrege -
<br />Downtown, PO Box 346, 424 West Ave, Holdrege, NE 68949 (referred to below sometimes as
<br />"Lender" and sometimes as "Beneficiary"); and Great Western Bank, whose address is 424
<br />West Ave, Holdrege, NE 68949 (referred to below as "Trustee ").
<br />CONVEYANCE AND GRANT. For variable consideration, Truster conveys to Trustee in trust, WITH POWER OF SALE,
<br />for the benefit of Lender as Beneficiary, at of Trustees right, title, and interest in and to the following described reel
<br />property, together with all existing or subsequently erected or affixed buildings, improvements and f all
<br />easements, rights of way, and appurtenances; all water, water rights and ditch rights (including stock in utilities with
<br />ditch or irrigation rights); and all other rights, royalties, and profits relating to the real propertrtyy, including without
<br />limitation all minerals, oft, gas, geothermal and similar matters, (the "Real Property ") located in Hall County,
<br />State of Nebraska:
<br />Part of fractional Lot Eight (8) in fractional Block One (1) of West's Subdivision, an Addition
<br />to the city of Grand Island. Hall County, Nebraska, more particularly described as follows:
<br />Commencing at the Northwest corner of Fractional Lot Eight (8), above described and
<br />proceeding In a Southerly direction a distance of 33.9 feet to a point on the West line of
<br />Fractional Lot Eight (8), thence Northeasterly at a 60 °35' angle for a distance of 64.17 Feet
<br />to a point on the North line of Fractional Lot Eight (8), thence proceeding in a Westerly
<br />direction along and upon the North line of Fractional Lot Eight (8) a distance of 55.95 Feet
<br />to the place of beginning.
<br />The Real Property or its address Is commonly known as 2323 W Old Lincoln Hwy, Grand
<br />island, NE 68803.
<br />CROSS.COLLAT RAUZAT1ON, in addition to the Note, this Deed of Trust secures all obligations, debts and liabilities,
<br />plus interest thereon, of Trustor to Lender or any one or more of them, as weft as all daims by Lender against Trustor
<br />or any one or more of them, whether now existing or hereafter arising, whether related or unrelated to the purpose of
<br />the Note, whether voluntary or otherwise, whether due or not due, direct or Indirect, determined or undetermined,
<br />absolute or contingent, liquidated or unliquidated, whether Trustor may be liable indhridually or jointly with others,
<br />whether obligated as guarantor, surety, accommodation party or otherwise, and whether recovery upon such amounts
<br />may be or hereafter may become barred by any statute of limitations, and whether the obligation to repay such amounts
<br />may be or hereafter may become otherwise unenforceable. If the Lender is required to give notice of the right to cancel
<br />under Truth in Landing in connection with any additional loans, extensions of credit and other liabilities or obligations of
<br />Truster to Lender, than this Deed of Trust shall not secure additional loans or obligations unless and until such notice is
<br />given.
<br />FUTURE ADVANCES. In addition to the Note, this Deed of Trust secures at future advances made by Lender to Truster
<br />whether or not the advances are made pursuant to a commitment. Specifically, without limitation, this Deed of Trust
<br />secures, in addition to the amounts spedfied In the Note, all future amounts Lender in its discretion may Ivan to
<br />Truster, together with at Interest thereon.
<br />Truster presently assigns to Lender (also known as Beneficiary In this Deed of Trust) at of Trustors right, title, and
<br />interest in and to alt present and future leases of the Property and all Rents from the Property. In addition, Trustor
<br />grants to Lender a Uniform Commercial Coda security interest in the Personal Property and Rents.
<br />THIS DEED OF TRUST, INCLUDING THE ASSIGNMENT OF RENTS AND THE SECURITY INTEREST_ IN THERENTS AND _ _
<br />PERSONAL PROPERTY, IS GIVEN TO SECURE (A) PAYMENT OF THE INDEBTEDNESS AND (B) PERFORMANCE OF
<br />ANY AND ALL OBLIGATIONS UNDER THE NOTE, THE RELATED DOCUMENTS, AND THIS DEED OF TRUST. THIS
