4.18 Reconveyance. Upon Grantee's written request, and upon surrender to Trustee for <br />cancellation, release or satisfaction of this Security Instrument or a certified copy thereof and any <br />note, instrument, or instruments setting forth all obligations secured hereby, Trustee shall <br />reconvey or release, without warranty, the Property or that portion thereof then held hereunder. To <br />the extent permitted by law, the reconveyance, release or satisfaction may describe the grantee as <br />"the person or persons legally entitled thereto" and the recitals of any matters or facts in any <br />reconveyance, release or satisfaction executed hereunder shall be conclusive proof of the <br />truthfulness thereof. Grantee and Trustee shall not have any duty to determine the rights of <br />persons claiming to be rightful grantees of any reconveyance, release or satisfaction. Any notice, demand, request or other communication that Grantee or <br />Grantor may desire or be required to give to the other shall be in writing and shall be mailed or <br />delivered in the manner set forth in the Credit Agreement or as required by law. Except as <br />otherwise specifically required hereunder or by applicable law, notice of the exercise of any right <br />or option granted to Grantee by this Security Instrument is not required to be given. All notices, <br />demands or other communications to the Trustee shall be considered as properly given if delivered <br />personally or sent by first class United States Postal Service mail, postage prepaid, or by Overnight <br />Express Mail or by overnight commercial courier service, charges prepaid, except that notice of an <br />Event of Default may be sent by certified mail, return receipt requested, charges prepaid. Notices <br />so sent shall be effective three (3) Business Days after mailing to the Trustee, if mailed by first <br />class mail, and otherwise upon delivery or refusal; provided, however, that non - receipt of any <br />communication as the result of any change of address of which the sending party was not notified <br />or as the result of a refusal to accept delivery shall be deemed receipt of such communication. For <br />purposes of notice, the address of the Trustee shall be: <br />5.03 Covenants Run with Land. All of the covenants of this Security Instrument shall <br />run with the land constituting the Premises. <br />5.04 Governing Law.
