leases, contracts or agreements entered into for the lease, rental, hire or use by the Trustor <br />of any equipment or service in connection with the operation, maintenance or occupation <br />of the Land and Improvements (all of the foregoing are hereinafter collectively referred <br />to as the "Contracts and Permits "); and <br />(o) all products and proceeds of the property described above. <br />The Land, Improvements, Additional Lands, Fixtures, Leases, Rents, Accounts, <br />Equipment, Awards, Tax Certiorari, Proceedings, Contracts and Permits and all other real and <br />personal property described in this paragraph are hereinafter collectively referred to as the <br />"Property." <br />This Deed of Trust is given to secure a certain Promissory Note of even date herewith, <br />executed by Trustor and payable to the order of Beneficiary in the original principal amount of <br />$200,000.00 (herein referred to as the "Promissory Note ") and interest thereon according to the <br />terms of the Promissory Note, with any and all extensions, renewals, modifications, or <br />substitutions thereof and any other amounts now or hereafter payable by Trustor to Beneficiary. <br />The Note, Trustor's obligations thereunder, all such debts, liabilities, and obligations of Trustor <br />hereunder and all other obligations or indebtedness now or hereafter payable by Trustee to <br />Beneficiary are all collectively hereinafter referred to as the "Obligations ". <br />TO PROTECT THE SECURITY OF THIS DEED OF TRUST, TRUSTOR HEREBY <br />COVENANTS AND AGREES AS FOLLOWS: <br />2. Payment of Obligations. Trustor shall promptly pay and perform the Obligations <br />when due. <br />3. Warranty of Title. Trustor is lawfully seised and possessed of good and <br />indefeasible title and estate to the Property hereby conveyed and has the right to grant and <br />convey the Property; the Property is free and clear of all liens and encumbrances except <br />easements, restrictions and covenants of record; and Trustor will warrant and defend the title to <br />the Property against all claims and demands. <br />4. Maintenance and Compliance with Laws. Trustor shall keep the Property in good <br />repair and condition and shall not commit waste or permit impairment or deterioration of the <br />Property. No improvement now or hereafter erected upon the Property shall be altered, removed <br />or demolished without the prior written consent of Beneficiary. Trustor shall comply with all <br />laws, ordinances, regulations, covenants, conditions and restrictions affecting the Property and <br />not commit, suffer or permit any act to be done in or upon the Property in violation of any law, <br />ordinance, regulation, covenant, condition or restriction. <br />5. Insurance. Trustor, at its expense, will maintain with insurers approved by <br />Beneficiary, insurance with respect to the improvements and personal property constituting the <br />Property against loss by fire, lightning, tornado, and other perils covered by a standard extended <br />coverage endorsement, in an amount equal to at least 100% of the full replacement value thereof; <br />and insurance against such other hazards and in such amount as is customarily carried by owners <br />and operators of similar properties and as Beneficiary may reasonably require for its protection. <br />Trustor will comply with such other reasonable requirements as Beneficiary may from time to <br />4830 - 2329 - 68392 4 <br />201702895 <br />
