<br /> all applicable federal, state, and lacal �aws, regulatians and ordinances, including without limitativn aff
<br /> En�ironmental Laws. Trust�r auth�ri�es Lender and its agents �o enter upon the Property �o make 5LlCh
<br /> inspections and fies�s, at Trustor's expense, as Lender may deem appropr�ate to determine c�mpliance o�f the
<br /> Property with this seCtian of the Deed o# Trust. Any inspections or �ests made by Lender sha[l be for Lender's
<br /> purpases an�y and shafl not b� cQnstrued to create any respvnsibi[ity or liability on the par�of Lender to Trus�or or
<br /> to any other per�an. The r�presenfiations and warran�ies c�ntained herein are based an Trustor's due diligence in
<br /> in�estigating �he Property �#�r Hazardous Substances. Trus�or hereby ��� releases and wai�es any future claims
<br /> agains� Lender fo�- indemnity or �ant�ibution in the e�ent Trustar be�om�s liab�e far c�eanup or other costs under
<br /> any such laws; and �23 agrees to indemni�y, de�end, and hold harmless Lender against any and all claims, losses,
<br /> I�abilities, damages, pena�ties, and expenses which Lender may direc�ly or indirectly sustain or suffer resulting�rom
<br /> a breach of this sect�on of the ❑eed of Trust or as a consequence of any use, generat�on, manufiac�ure, s�orage,
<br /> d�sposal, release or threatened release occurring prior to Trustar's vwnership or in�erest in the Property, whether or
<br /> �nQt the same was or should ha�e been known to Trustor. The pro�isions of this section o� the Deed of Trust,
<br /> incfuding the obligation to indemni�y and defend, shall sur�i�e the payment of the Indebtedness and th�sa�isfac�ion
<br /> and recon�eyance of the lien o��his Deed af Trus�and shall n�t be a��ected hy Lender's acquisition of any in�erest
<br /> in�he Property, whether by forecfosur�or otherwise.
<br /> Nuisance, Vllaste. Trustor shall not cause, conduct or permit any nuisance nor c�mmit, permit, or suffer any
<br /> stripping of vr waste on or t❑ the Praperty vr any portion o� th� P�oper�y. Wi�hvu� limiting the generality ❑f the
<br /> �or�going, Trustor will nofi remo�e, vr grant ta any other party �he right to remv�e, any timber, minerals �in�luding
<br /> oil and gas}, caal, clay, scvria, sai�, gra�el or rock products without Lender`s prior written cansent.
<br /> Remo�af of ImproWem�nts. Trustor shal! not demolish or remo�e any lmpra�ements�rom�he Real Pr�perty withvut
<br /> Lender's priar written consen�. As a �ondition to the remo�al of any Improvements, Lende� may require Trustor to
<br /> make arrangements satis�actary tv Lender to replace such lmpra�emen�s wi�h Impra�emen�s �f at least equal
<br /> �afu�.
<br /> Lender's Right to Enter. Lender and Lender's agen�s and �epresentat��es may enter upvn the Reaf Prop�rty a� all
<br /> reasvnable times to afitend �o Lender's interests and �o inspect the Reaf Pr�perty fvr purposes ❑f Trustor's
<br /> compliance with the terms and conditions of this Deed o�T�ust.
<br /> � Cvmpliance with Gv�ernr�ental Requirements. Trustor shall pramptly camply wi�h all laws, ordinances, and
<br /> �egulations, now or hereafter in e��ect, of all g��ernmental authori�kies applicable ta the use or occupancy of the
<br /> Praperty, inciuding wi�hou� limitatian, the Americans Wi�h Disabilities Ac�. Trustor may �ontest in g�od �aith any
<br /> su�h faw, ordinance, or regulation and withhvid compliance during any prviceeding, including appropriat� appeals,
<br /> so �ong as Trus�or has notified Lender in writing prior to doing so and sv long as, in Lender's sale opinian, Lend�r's
<br /> �nterests in the Properfiy are not jeopardized. Lender may require Trustor to post adequate security or a surety
<br /> bond, reasvnably satisfact�ry ta Lender, to protec�Lender's interest.
<br /> �uty tv Prvte�#. Trustor agrees neither �o ahandan or fea�e unattended the Property. Trus�or shalf do al� other
<br /> acts, in additian to thos� a�ts se��vrth a�o�e in this sectifln, which�rvm the character and use of the Property are
<br /> reasonably necessary to protect and preser�e the Praperty.
<br /> DUE�N SALE-C�NSENT BY L�ND�R. Lender may, at Lender's aption, declare immedia�ely due and payab�e all sums
<br /> secured E�y this Deed o#Trus�upon the sale or transfer, wi�hout Lender's prior writt�n �onsent, of all or any part of the
<br /> Rea� Property, or any interest in the Real Property. A "sale or trans#er" means the can�eyance of Rsal Property or any
<br /> right, tit�e or interest in �he R�a� Prvper�y; whether legal, beneficia� or equ�table; whether �oiuntary ar €n�oluntary;
<br /> whe�her �y outright sale, deed, insta��ment sale cvn�ract, land contract, contract fnr deed, �easehofd interest wi�h a
<br /> t�rm greater than �hree �3� years, lease-option contract, or by sale, assignment, or trans�er ❑f any benefiiciaf int�rest in
<br /> or to any land �rust hofding title tv �he Real Property, �r hy any other me�hvd vf �on�eyan�� o� an interes� in the Real
<br /> Property. I� any Trus�or is a corporation, partnership or limited liability �vmpany, transfer afso includ�s any change in
<br /> ownership of more than twenty-fi�e per�ent ��5°/03 of the�o�ing stock, partnershfp int�rests or limi�ed liabifity �ompany
<br /> inter�sts, as the cas� may be, of suCh Trustor. H�we�er, this op�ion shal! not he exercis�d by Lender if such exercise
<br /> is prahibited by fed�ral law�r hy Nebraska law.
<br /> �'AXES AND LIENS. The following pro�isions relating �o the taxes and f��ns on the Property are part af this aeed of
<br /> Trust:
<br /> Paymen#. Trustar shafl pay when due �and in all e�ents prior to de�inquency} ali taxes, sp��ial taxes, assessments,
<br /> charges �including water and sewer}, fines and impositions �e�ied against or on account af the Pr�p�rty, and shall
<br /> pay when due all c�aims for work d�ne ❑n or fior ser�ices rendered or materiaf �urnished ta �he Property. Trusfior
<br /> shal! main�ain the Property free af all �iens ha�ing prio�ity o�er�r equal �o the interest o�Lender under this Deed of
<br /> Trust, except for the lien o� taxes and assessments not due and except as o�herwise p�o�ided in this Deed o�
<br /> Trust.
<br /> Right to Gon#est. Trus�or may withhold payment af any �ax, assessment, or �ia�m in cflnnec�ion with a gavd faith
<br /> dispute o�er th� obligativn t❑ pay, so long as L�nder's interest in the Pr�per�ty is not j�opardi�ed. If a lien ar�ses or
<br /> is f�led as a result of nonpayment, Trustor shaff within fi�t��n �15� days af�er the lien arises ar, i# a lien is fifed,
<br /> wi�hin fifteen �15� days after Trusto� has natice vf �he filing, se�ure the dis�harge of the lien, ❑r i� �equ�s�ed by
<br /> Lender, depvsit with Lender Gash or a su�ficient corparate surety bond vr other se�ur�ty satisfac�ory t� Lender in an
<br /> amount sufficient to discharge the lien pfus any costs and attornsys' fees, vr o�her charges that could accrue as a
<br /> �-esu�t o�a foreclosure€�r sale under the lien. In any contest, Trustor shal� defend i�self and L�nder and shall satis�y
<br /> any ad��rse judgmen�bef�re en�orcement agains��he Prvperty. Trustor sha�i name Lender as an additivnal ❑�ligee
<br /> under any surefy#�ond furnished in the contest proceedings.
<br /> E�idence of Payment. Trustor shall upon demand furnish ta Lender satisfactvey e�idence o� payment af the taxes
<br /> vr assessments and shall author��e the appropriate g���rnmental o�ficial t� deli�er tv Lender at any time a writt�n
<br /> s�atement❑�the taxes and assessments against the Property.
<br /> Nvtice v�C�nstructic�n. Trus�or shaf[ notify Lender at leas� fifteen �'!5� days b���re any wark is commenced, any
<br /> �e���ces are -�urnished, or any materials are supplied to the Proper�y, �f any mechanic's lien, materialmen's lien, or
<br /> ❑th�r li�n cauld be asserted on accoun� of the work, ser�ices, �r ma�erials. Trustar w�l� upon request of L�nder
<br /> �urnish to Lender ad�ance assurances sa�isfactory to Lender that Trustor can and will pay the cos� ❑f such
<br /> impro�ements.
<br /> PR�PERTY DAMAGE 1N5URAN�E. The fa€�owing pra�isions relating tv insuring th� Property are a part of this Deed ofi
<br /> Trust.
<br /> Maintenance af Insuran�e. Trus�or shall pracure and maintain policies vf fire insurance with standard extended
<br /> couerage endvrsements on a rep�acemen� basis for the fuff insu�able �alue �o�ering all Impro�ements �n the Rea1
<br /> Property �n an amount sufficient tv a�oid applica�ian�of any coinsurance clause, and with a standard mvr�gagee
