2� 17�2� 17 <br /> � <br /> �BLI�ATI�NS AND THE RELEASE, RE��NVEYANCE �R PARTIAL RE�4NVEYAN�E �F <br /> THIS I�EED�F TRUST. <br /> (e} Trustor sha�l advise Benef ciary�n writing wi�hin ten���} days of Trustor's disco�ery of any <br /> occurrence or candition �n the Trust Proper�y or on any rea� property adj�ining or in the vicinity of the <br /> Trus�t Proper�y that daes or could cause all or any part of th�Trust Property�fl be cantaminated with any <br /> Hazardous Materials or o�hervvise be in violation of any Hazardous Materials Laws, or cause the Trust <br /> Proper�y to be suhj ec�ta any restrictiflns on the ownership, �ccupancy,transferabzlity or use thereof under <br /> any Hazard�us Mater�a�s Laws. <br /> 3.14 Protiec�ion af S ecur�ity. Trustar shall, at Trustor's sale expense: �a}pra�ect, preserve and <br /> defend the Trus� Property and Trustor's t�tle and righ� ta possession of the Trust Praperty against all <br /> adverse claxms; �b�if Trustor's interest in the Trust Property is a leasehald interest or estate, pay and <br /> perfonm in a time�y mar�er al� abligati�ns �o be pa�d an�.l�r performed by the �essee or�enant under th� <br /> lease or other agreement creating such leasehold in�erest ar estat�; and (c�prot�ct, preser�e and defend <br /> the security of this Deed of Trust and the rights and pawers of Beneficiary and Trustee under this Deed of <br /> Trust against al� adverse claims. Trustar sha�l gi�e B�neficiary and Trustee promp� n�tice in writing of <br /> th� asser�ion of any claim, the f�ing of any action or proceeding, or th� occurrence of any material <br /> damage, c�ndemnation offer or other action relating to or affecting the Trust Property and, if Trustor's <br /> interest in the Trust Prop�rty is a leasehold interest ar estat�, of any notice of default ar demand for <br /> performance under the lease or other agreement pursuant t� whi�h such leasehald interest or �state was <br /> creat�d or exists. <br /> 3.I 1 Acce tance of Trust• Powers and Duties of Trustee. Trustee accepts this trust when this <br /> De�d af Trus� is execute�i. From time �a time, upon written request of B�nef�ciary and, to the ext�nt <br /> requ�red by applicab�e �aw presentat�on of this I]eed of Trust for endorsement, and wx�hout affecting the <br /> persanal liability of any person for paymen� of any indebtedness �r performance �f any af the Secured <br /> �bliga�ians, B�I�1��1C1�, �r Trustee at Benef�ciary's direction, may, without abligation ta d� so ar <br /> �iabi�i�y therefor a.nd without no�ice: �a�reconvey all ar any part of the Trust Property from the lien af <br /> this D�ed of Trust; �b�conser�t ta the making of any map ar pla� of the Trust Property; and�c)j oin in any <br /> grant of easement or declaration of covenants and r�strictions with respec� �a th� Trust Property, or any <br /> extensi�n agreement or any agreement subordinat�ng the �ien or charg�of this I]eed�f Trust. Trustee or <br /> Benefic�ary may from time to time app�y �o any court of competent jurisdiction f�r aid and directian in <br /> the execution af the trusts and the enf�rcem�nt of i�s rights and remedies available under this D�ed Qf <br /> Trust, and may �btain orders or decrees directing, con.f'irming or approving acts in the execut�on of said <br /> �rusts and the enforcement af said rights and remedies. Trust�e has n� obligation to notify any party af <br /> any pending sale or any action or praceeding (�ncluding, bu� not limited ta, a�tions in wh�ch Trustor, <br /> Beneficiary�r Truste� shall be a party} unless held or cammenced and maintained by Trustee under this <br /> Deed of Trus�. Trustee shall no� be obligated �o perfarm any act require� af i�under this I]eed of Trust <br /> unless the performance af�he act is requested in wri�ing and Trus�ee is reasonably�ndemnified against a�1 <br /> losses, casts, liabi�ities and expenses in connectian therewith. <br /> 3.1� �om ensation• Excul ati�n• Indemnifica�ion. <br /> �a} Trustor shall pay all Trustee's fees and reimburse Trustee far all expens�s in the <br /> administration of�h�s trus�, includ�ng reas�nable attorneys' fees. Trustor shall pay Beneficiary reasonable <br /> c�mpensation for ser�ices render�d cancerning �his I]eed of Trust, includ�ng vvithout limitatian, the <br /> prov�dir�g of any stat�ment of amounts awing under any Secured �bligation. Benef�ciary shal� not <br /> direc�ly or indirectly be �iable to Trustar ar any other person as a cons�quence of: (i}the ex�rcise of any <br /> rights, remedies or powers granted ta Beneficiary in this Deed of Trust; ��i��he fai�ure or refusal �f <br /> Beneficiary ta perform or discharge any ob�iga�ion or l�ab�lity of Trustor under this Deed of Trust ar other <br /> agreement related�o the Trus�Property; �r(i�i} any loss susta�ned by Trus�or or any thYrd party as a result <br /> of Benefi�iary's fa�iure to lease the Trust Property after any Default or from any other act �r om3ssion of <br /> -�- <br />� <br />
