V. OWNER'S ASSOCIATION 201702371 A. The Owner agrees to use Cottonwood Lake in such a manner as not to interfere with the use of the lake by any other member, and in such manner as to create no nuisance, annoyance, or unlawful disturbance or which shall interfere with their peaceful use and enjoyment of their property. The Owner shall be responsible for the conduct and safety of his, her, or their guests. B. Each Owner acknowledges that Cottonwood Lake is potentially dangerous and there shall be no liability of any kind upon the Owners or Cottonwood Lake Association for any accident, injury, loss or damage occurring to any person or persons in connection with Cottonwood Lake, and the use of Cottonwood Lake by any Owner, his, her or their guests, shall be at the sole risk of the Owner and guests of the Owner. C. No organic- fueled boats shall be placed in or used on Cottonwood Lake by any Owner or their guests. D. Any personal property taxes levied and assessed against Cottonwood Lake Association shall be borne equally and paid by the members of Cottonwood Lake Association through the annual or special assessments as described herein. E. No minnows or any type of bait fish shall be used for fishing in Cottonwood Lake. F. The Owners agree to keep the shoreline abutting the lot owned by the Owner in a good state of repair, and the Owners agree that no unsightly docks will be constructed or used by any such Owners. No docks shall extend beyond a reasonable length into the lake nor shall any boat storage garage be built upon the lake shore. No lot shall be increased in size by filling in the water it abuts. An owner's association named Cottonwood Lake Association has been incorporated. It shall be the responsibility of the Association to enforce all of the covenants, restrictions and conditions contained in this agreement. The Board of Directors may establish from time to time, rules and regulations regarding practices and uses of Cottonwood Lake frontage lots. A. Notice quorum and voting requirements of any meeting called for the purpose of taking any action authorized herein shall be governed by the Articles of Incorporation and By -Laws of Cottonwood Lake Association. B. The Owners and parties to this Agreement, for good and valuable consideration, including the protection and improvement of Cottonwood Lake, hereby covenant and agree to pay to Cottonwood Lake Association (1) annual assessments or charges, and (2) special assessments for capital improvements, such assessments to be
