2� 17�2359 <br /> �'I. Hazard�us Substances. As used in this S�cti�n Z 1: �a} "Hazurdous Suhstances"are those substances <br /> defined as toxic or hazardaus substances, pollutants, or wastes by En�iranmenta� Law and the following <br /> substances: gasoline, kerasene, other flammable or toxic petroleum products, t�xic pesticides and herbicides, <br /> �olatile sol�ents, materials containing asbestos or farmaldehyd�, and radioacti�e mat�rials; �b} <br /> "Lnvironmental�aw"means federa� laws and laws of the jur�sdiction where the Property is la�ated that <br /> rela�e to health, safety ar en�ironmen�al protection; �c} "�`nviranmental Cleanup"includes any resp�nse <br /> actian, remedial action, �r remo�al action, as defined in En�ironmental Law; and�d}an "Environmental <br /> Condition"means a condition that can caus�, contribute ta, or athervvise tr}gger an En�ironmental Cleanup. <br /> Barrower sha�l not cause ar permit the pres�nce, use, disposal, storage, or releas�of any Hazardous <br /> Substances, or threaten to release any Hazardous Substances, on or in the Property. Borrower shall not do, <br /> nor a�lavv anyone eise to do, anything affecting the �rope�-�ty �a}that is in �ialation of any En��ronmental <br /> Law, �b}which creates an En�ir�nmentai Condi�ion, or�c�which, due to the presence, use, ar release of a <br /> Hazardaus Substance, creates a conditian that ad�ersely aff��ts the�a1ue of the Froperty. The preceding two <br /> sentences shall not apply to the presence, use, �r storage on the Froperty�f small quantities of H azardous <br /> Substances that are generally recognized to be appr�priate to normal res�dential uses and to maintenance af <br /> the Property (including, but not l�m�ted to, hazardous substances in c�nsumer products}. <br /> Borrower shall promptly gi�e Lender written notice of�a}any in�est�gation, c�aim, demand, lawsuit or other <br /> action by any go�ernmental or regu�atory agency or pri�ate party in�ol�ing the Property and any Hazardaus <br /> Substan�e vr En�ironmental Law of which Borrawer has actual knflw�edge, (b}any En�ironmental <br /> Condition, including but not limited to, any spilling, leak�ng, discharge, release or threat of release of any <br /> H azardous Substance, and�c� any candition caused by the presence, use or release of a H azardous Substance <br /> wh�ch ad�ersely affects the�a1ue af the Property. If Borrower learns, ar is natified by any go�ernmental vr <br /> regulatory authority, or any pri�ate party, that any remo�al or other remediation of any Hazardous 5ubstance <br /> affecting the Property is necessary, Borrower sha11 promptly take all necessary remedial actions in <br /> accordance with En�ironmental Law. Na�hing here�n sha11 �reate any nb�igation on Lender for an <br /> En�ironmental�leanup. <br /> Non-Unifarm �v�enants. Borrower and Lender co�enant and agree as foll�ws: <br /> �2. Acceleration; Rem�dies. Lender 5hai1 gi�e nvti�e to B�rrower prior to acCeleration following <br /> Borrower'� breaeh of any co�enant or agreement in this Se�urity Instrument(but not prior to <br /> aCceleration under Section 18 unless Applicable Law pra�ides otherwise}. The notice shall specify: (a} <br /> the default; (b}the action required ta cure the default; �c�a date, not le5s than 3U days from the date <br /> the noti�e is gi�en to Sorrower, by which the default must be cured; and �d�that failure ta cure the <br /> default on or before the date 5pecified in the notice may re5ul�in acceleration of the sum�secured by <br /> this Security Instrument and sale of the Prvperty. The notice sha11 further inform Borrower vf the <br /> right to reinstate after a�celeration and the right tn bring a court action to assert the n�n-existen�e af a <br /> default vr any other defense af Borrower to acceleration and sale. If the default is nflt cured on or <br /> before thQ date specified in the notice, Lender at its option may require immed�ate payment in ful� af <br /> all sum� secured by this Security Instrument without further demand and may in�vke the power of sale <br /> and any other remedie5 permitted by Applicable Law.
