<br /> Z'I. HazardousSubstances.As used in this Section 21: (a} "Hazardou.s Sufi.sta�ce.s"are those substances
<br /> defined as toxic or hazardous substance�,pollutants,or vvastes by En�iroumental Law and the fol�owing
<br /> substances: gasoline,kerosene,other flammab�e or toxic petroleum products,toxic pesticides and herbicides,
<br /> volatile solvents, materials contain�ng asbestos or formaldehyde, and radioa�tive materials; (b}
<br /> "�r�vironmental Law"means fe�erallaws and laws of the jurisdiction where the Property is located that
<br /> relate to health, safety or environmen�tal protection; (c} "��avirort�raer�tal Clear�up"includes any response
<br /> action, remedial action, or removal action, as def ned in Environmental Law; and(d)an "Enviror�naental
<br /> Cortdition"means a condition that can cause,contribute ta, or other�v�se trigger an En�ironmental Cleanup.
<br /> Borrower shall not cause or permit the presence,use,disposal,storage,or release of any Hazardous
<br /> Substances,ar threaten to r��ease any Hazardous S�bstances,on�r in the Praperty. Bonower�ha11 not da,
<br /> nor allow anyone else to do,anything affecting the Property(a}that is in violation of any En�ironmental
<br /> Law,(b}which crea�es an Enviranmental Condition,or(c}wb�ch,due to the presence,use,or release of a
<br /> Hazardous Substance,creates a condition that ad�ersely affects the�a1ue of the Property.The preceding two
<br /> sentences sha11 not apply to the presence,use,or storage on the Property of sma��yuantities of Hazardous
<br /> Substances that are generally recognized to be appropriate to normal residential uses and to maintenance of
<br /> the Property(including,but not limited to,ha2ardous substances�n consumer products).
<br /> Borrower sha11 promptly gi�e L�nder written notice of�a}any in�estigation,c�aim,demand, lawsu�t or other
<br /> action by any govemmental or regu�atory agency or private party in�olving the Property and any Hazardous
<br /> Substance or Environmenta.I Law of tiuhich Borrower has actual knowledge,(b}any En�ironmental
<br /> Condition, including but not 1imi�ed to,any spilling, leaking,discharge,release or threat of reiease of any
<br /> I�azardous Substance,and(c�any condition caused by the presence,use or reteas�of a Hazardous Substance
<br /> which ad�ersely affects the�alue of the Property. If Borrotiver learns,or is notified by any go�emmental or
<br /> regulatory authority,or any pri�ate party,that any removal or other remediation of any Hazardous Substance
<br /> affecting the Proper�y is necessary,Borrower sha11 promptly take a11 necessary remedial actio�.s in
<br /> accordance vvith Environmental Law.Nothing herein sha��create any obligat�on on Lender for an
<br /> En�ironmental Cleanup.
<br /> Non-Uniform Go�enants.Borrower and Lender co�enant and agree as follows:
<br /> 22. Acceler�tion;Remedies.Lender shall gi�e not��e to Borrower prior to�cceleration foi�owing
<br /> Borrawer's breach of any�ovenant or agreement in tbis Seeurity Instrument�but not priar to
<br /> accelerati�n under Section 18 unless App�icable Law provides otherwise}.The natice sha�� specify: �a�
<br /> the default;tb�the action requ�red to cure t�e default;tc)a date,not less�han 3�days fram�he�ate
<br /> the notice is gi�en to Borrower,by which the default must�e cured; and td}tbat failure to cure the
<br /> default on or befare the date speCified in tbe notiee may result in acceleration af tbe sums secured by
<br /> this Security Instrument and sale of the Property.The notice sball further inform Borrower of the
<br /> right to reinstate after ac�eleration and the right ta br�ng a eourt action to assert the non-existen�e of a
<br /> default ar any�ther defense of Borrower to acceleratian and sale.If tbe default is not cured on�r
<br /> before tbe date speeifie�io tbe notice,Lender at its�ption may require immediate payment in full af
<br /> all surns secured by this Seeurity Ins�rument wi�bout further demaud and may invoke the pawer of sa�e
<br /> and any otber remedies permitted by App�icable Law.Lender shall be entitled to cal�ect all expenses
<br /> in�urred in pursuing the remedies pro�ided in this Seetion 22,inCluding,but not limited to, reasanable
<br /> attorneys'fees and costs af title e�idence.
