1 <br />1 <br />1 <br />RESOLUTION 2017 -90 <br />2017019 '5 <br />WHEREAS, a public utility easement is required by the City of Grand Island, from <br />TPCR Development, LLC, in Summerfield Estates Tenth Subdivision, City of Grand Island, Hall <br />County, Nebraska and more particularly described as follows: <br />Attest: <br />A PERMANENT UTILITY EASEMENT CONSISTING OF PART OF LOTS 10 AND 11 OF <br />SUMMERFIELD ESTATES TENTH SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL <br />COUNTY, NEBRASKA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: <br />COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT TEN (10), SAID POINT <br />ALSO BEING ON THE NORTH RIGHT -OF -WAY (R.O.W.) LINE OF 13TH STREET AND THE <br />POINT OF BEGINNING; THENCE ON AN ASSUMED BEARING OF S89 °05'09 "W ALONG <br />SAID NORTH R.O.W. LINE A DISTANCE OF 54.00 FEET; THENCE N29 °26'18 "E A <br />DISTANCE OF 104.28 FEET TO A POINT ON THE EAST LINE OF SAID LOT ELEVEN (11); <br />THENCE S01 °44'38 "E ALONG SAID, EAST LINE A DISTANCE OF 90.00 FEET TO THE <br />POINT OF BEGINNING. SAID PERMANENT UTILITY EASEMENT CONTAINS 2430 <br />SQUARE FEET MORE OR LESS. <br />WHEREAS, an Agreement for the public utility easement has been reviewed and <br />approved by the City Legal Department. <br />NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF <br />THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, <br />authorized to enter into the Agreement for the public utility easement on the above described tract of <br />land. <br />BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to <br />execute such agreement on behalf of the City of Grand Island. <br />Adopted by the City Council of the City of Grand Island, Nebraska, March 28, 2017. <br />RaNae Edwards, City Clerk <br />
