<br /> DEF�NiT��NS. The following capita�ized words and terms shall ha�e the foliowing meanings when us�d in this Deed of
<br /> Trust. lJnless specifically stated t❑ the Gontrary, all references to dolfar amt�unts shall mean amounts fn lawfu� money
<br /> of the lJnited States o# Am�r�ca. Words and terms used in �h� singu�ar shall include the plural, and the plural shall
<br /> include th� s�ngular, as the c�ntext may r�quire. VVords and �erms nat otherwise defined in this Deed of Trust shall
<br /> ha�e the meanings a�tributed to such terms in the Uniform �ommerciar Cad�:
<br /> Beneficiary. The word "Beneficiary" means Fi�e Poin�s Bank, and its successors and assigns.
<br /> Borrvwer. The word "gorrower" means CYA MANAGEMENT LLC, ARTUR� NUNEZ JlMENEZ and CLAIJDIA
<br /> NUNEZ and includes all co-signers and co-makers signing the Note and al1 their successars and assigns.
<br /> Deed vf Trust. The wards "Deed of Trust" mean this ❑eed o� Trust amang Trustor, Lender, and Trustee, and

<br /> Default. The word "Defauit" means the Default set for�h in this Deed ❑f Trust in the se�tion titled "Default".
<br /> En�ironmental Laws. The wards "En�ironmental Laws" mean any and a!� sta�e, federaE and laca� sta�ures,
<br /> regulations and ordinances relating ta the protec�ion of human health �r the en�ironment, including withaut
<br /> limita�ion the Comprehensive En�ir�nmental Respvns�, C�mpensation, and L�ability Act of 1980, as amended, 42
<br /> U.S.C. Se�tion 96�1, et seq. t"CERCLA"}, the 5uperfund Amendments and Reauthorization Act of 198�, Pub. L.
<br /> No. 99-499 �"SARA"}, the Hazardaus Materials Transportation Act, 49 U.S.C. 5e��ion 18�1, et seq., the Res�urce

<br /> Event of Defauit. The words "E�ent of De#ault" mean any of the e�ents af defau�t set forth in this aeed of Trust in
<br /> the ��ents af default sectian af this Deed o�Trust.
<br /> Existing Endeht�dness. The uvords "Existing Indebtedness" mean th� indebtedness describ�d in the Existing Liens
<br /> pra�isiQn��this Deed of Trust.
<br /> Guaranty. The word "Guaranty" means the guaranty from guaranto�, endorser, sur�ty, or accommodation party tv
<br /> Lender, including without limitation a guaranty❑�all or par��f the Nnte.
<br /> Hazardaus Substances. The words "Hazardaus Substances" mean materials that, becaus� ❑f their �uantity,
<br /> concentratian or physical, chemical ar infectious characteristics, may cause or pvse a present or patentiaE hazard
<br /> to human health ar the en�ironment when improperly us�d, treat�d, stored, dispased af, generated, manufactured,
<br /> transported or ❑therwise handfed. The words "Ha�ardous Substances" are used in their �ery braadest sense and
<br /> include withaut limitation any and a�� hazardous ar tnxi� substances, materials ar waste as defined by or fisted
<br /> under the En�iranmental Laws. The term "Hazardous Substances" alsa includes, without limitation, petraleum and
<br /> petro�eum �y-products or any fraction thereof and asbestos.
<br /> Impro�emsn#s. The word "Impro�ements" means all existing and future impro�ements, �ui�dings, structures,
<br /> mobile homes affixed on �he ��al Property, facilities, additians, replacements and other canstructEon on the Rea!
<br /> Property.
<br /> Indebtedness. The word "Indebtedness" means all principal, interest, and other, amounts, cos�s and- �xpenses
<br /> payabie under the Note or Related Dacuments, tagether with al[ renewals of, extensions of, mo.difications o�,
<br /> cons�lidations af and substitutiQns fvr the Note ar Related Documents and any amaunts expended �r ad�an�ed by
<br /> Lender t❑ discha�ge Trustor's v�ligatians �r expenses incurred by Trustee ❑r Lender ta enforce Trustar's
<br /> ohligatians under this Deed of Trust, together with interest on su�h amounts as pro�ided in this �eed of Trust.
<br /> Specifically, w�thout limitation, Indebtedness inc�udes the #uture ad�ances set fiorth in the Future Ad�ances
<br /> p�o�ision, together with all interest there�n and all am�unts that may be indirectly secured by th�
<br /> �rassWCailatera�ization pra�+s�on of this Deed of Trust.
<br /> Lender. The word "Lender" means Fi�e Pvints Bank, its successars and assigns.
<br /> Note. The w�rd "N�te" m�ans the promissvey note dated March �9, ��17, in the �riginal princi�al amount
<br /> of $'19�,�2�.�� from Borrower ta Lender, tflgether with all renewais of, extensions �f, madifications of,
<br /> refinan��ngs ❑f, consalidations af, and substitut�ans far the promissory note ar agreement�
<br /> Personal Property. The wo�ds "Pers�nal Pr�p�rty" mean a�! equipment, fixtures, and other artic�es af personal
<br /> property now or hereafter own�d by Trustar, and naw ar hereafter attached or affixed ta the Real Property;
<br /> together with a!I accessions, parts, and additions ta, all replacemen�s ��, and all substitutions fvr, any of 511Ch
<br /> property; and tag�ther with all pro�e�ds �including withaut �imitation all �nsurance proceeds and r��unds ❑f
<br /> prem�ums; #rom any sale or ather dispasition o�the Praperty.
<br /> Property. The word "Property" means collecti�ely the F�eal Property and the Personal Prvperty.
<br /> Rea� Property. The wards "R�al Property" mean the real property, interests and rights, as �urther described in this
<br /> Deed of Trust.
