<br /> Suhs��quent Taxes. I� any tax to which this sect�:on appfi�s is enacted subsequen� t� the date of th�s Deed of
<br /> Trus�, �his e�ent shall ha�e the same ef�fect as an E��nt of Default, and Lende� may exercise any or a!I v# its
<br /> a�ailable remedies �or an E�ent of Default as pro�ided below un[ess Trustor e�ther 4�� pays the tax b�fore it
<br /> becames delinquent, or �2� cvntests the tax as pro�ided abo�e in the Taxes and Liens section and deposits with

<br /> SEC�IRIT� AGREEMENT; FINANCING �TATEMENTS. The �o�lawing pro�isions rela�ing ta this Deed of Trust as a

<br /> Se�urity �nterest, Upon r�quest by Lender, Trustor shall #ake whate�er act�on �s �eque�ted hy Lender ta perfe�t
<br /> and �ontinue Lender's security interest in the Rents and Personal Property. ln additian to recvrding this ❑eed o�
<br /> Trus� in the real property recards, Lender may, at any time and wi�hout further authori�ation ��om Trustor, fif�
<br /> executed �aunterparts, cvpies or reproductions o� �his Deed o� Trust as a �inancing statement. Trustar shall
<br /> reimburse Lender far all �xpenses in�urred in perfectEng or continuing �his seGurity in�erest. Upon d��ault, T�-ustor
<br /> shall nvt remo�e, se�er vr detach the Personal Prvperty �rom the Pr�p�rty. Upon de#aul�, Trus�or shalf ass�mhle
<br /> any P�rsonal Property not a�fixed to the Property ir� a manner and at a place re�s�nabiy cvn�enien��v Trustor and
<br /> Lender and make it a�ailahfe fio Lender within three {3} days af�er receipt of ►dvritten demand frvm Lender to the
<br /> extent perm�tted by appli�able �aw.
<br /> Add�ess�s. The mailing addresses �f Trustvr ��ehtar� and Lender �secured partyy from which information
<br /> con�ern�ng the security Enterest granted by this De�ed v�Trust may be a�tained �each �-s required by the Uniform
<br /> Commerciaf Code� are as stated on the first page v�f th�s Deed of Trust.
<br /> FURTHER ASSURANCES; ATTQRNEY-IN-FACT. The follawing pro�isions reiating ta further assurances and
<br /> attarney-i�-fact are a part af this Deed vf Trust:
<br /> Further Assurances. At any �ime, and fram #ime to time, upon request of L�nder, Trust�r wi�! make, exe�ute and
<br /> deli��r, or wil! cause to be made, executed�r deli�ered, ta Lender or�a Lender's designee, and when reques�ed by
<br /> Lend�r, cause �o be filed, re�orded, refifed, o� rerecorded, as th� case may be, a� such times and in such offices
<br /> and places as Lender may deem appropriat�, any and a[I such mortgages, deeds vf trus�, security deeds, s�curity
<br /> agreements, financing statements, con�inua�ion statements, instruments v� �urther assurance, certificates, and
<br /> other documents as may, �n the so�e vpinian of Lender, be necessary vr desirabfe in �rdE�to effec�ua�e, compfete,
<br /> p�rfe�t, continue, or preser�e �1� Trustvr's ob�igations under the Note, this ❑eed �� Trust, and the Rela#ed
<br /> Documents, and ��� �he liens anc� se�urity interests created #�y this Deed o#Trust as �irst and priar li�ns on the
<br /> Property, whether naw av►►ned or hereafter a�quired by Trustor. lJn�ess prvhibited by �aw or Lender agr��s to the
<br /> c�n�rary in w�it�ng, Trus�tor sha11 reimburse Lender for all costs and expens�s incurr�d �n connection with the

<br /> Attorney-in-Fa�t. �f Trustor fai�s to do any of the things refierred to �n the prec�ding �ar�graph, Lender may d� s�
<br /> #or a�d �n the name vf Trustar and at Trustor's expense. Far such purposes, Trustor hereby irre�v�ably appoints
<br /> Lender as Trust�r's attorney-in-fact#or the purpose ❑f making, executing, deli�ering, �ilin�, record�ng, and doing all
<br /> other �hings as may be necessary vr desirable, in Lender's sale opinion, to accamplish the matters re�erred to in
<br /> �he pre�eding paragraph.
<br /> FULL PERF�RMANCE. If Trustor pays a11 the Indebt�dness, �nc�uding wi�hout limi�a�ian all fu=ure ad�ances, when due,
<br /> and athervvise performs all the obligations impas�d upon Trustor under this ae�d of Trust, Lender shall execut� and
<br /> deli�er to Trustee a request for full recon�eyanc� and shal[ execute and d�li�e� to Trust�r sui�able statements of
<br /> terminatian of any finan�ing statement an file e�idencing Lender's security interest in thE Ren�s and the Personal
<br /> Property. Any recon�eyance fe� required by law shall b� paid by Trustor, if permitted by app��cable law.
<br /> EVENTS �F DEFAULT. Each of the �all�wing, at Lender's ap�ion, shall constitu�e an E�ent cf ❑e�auit under this Deed
<br /> vf Trust:
<br /> Payrr�ent Default. Trustor fai�s to make any paym�nt when du� und�r the Indebtedness.
<br /> �ther De�aults. Trustor �ails to comp�y wi�h or ta perform any �ther term, ohfigaticn, co�enan� vr condition
<br /> cont�ined in �his Deed of Trust or in any vf the Rela�ed Do�uments or tv �omp[y with or to perfiorm any t�rm,
<br /> ob[igatifln, co�enant or��ndition contained in any other agreement�etween Lender and Trustor.
<br /> Gomplian�e Defaul�. Failure to comply with any athe� term, obliga�ion, ca�enant or c��ndit�on cvntained in this
<br /> �eed o�Trust, th� Na�e or in any of the Related ❑ocuments.
<br /> Default vn C�th�r Paymen�s. Failure af Trusta�within the�ime required by this Deed af T-ust to mak� any paymen�
<br /> �or taxes or insurance, or any other payment n�c�ss�ary ta pre�ent#iling of or to effect di��harge of any 1ien.
<br /> Default �n Fa�or of Third Par�ies. Should �rantar d��au�t under any loan, extension of credit, security agreemen�,
<br /> pu�chase or sales agreement, or any o�her agre�men�, in fa�or o�any ❑ther creditor ar Ferson that may materially
<br /> af�rec� any of Grantvr's prope�ty vr Grantor's ability ta repay the Ind�btedness �r Gr�ntor's ability to per�orm
<br /> Gran�vr's❑bligations und�r this Deed of Trust or any�vf the Re[ated Do�um�nts.
<br /> Fals� Statements. Any warranty, representation or statement made o� fu�nished ta Lender by Trustor or on
<br /> Trustor`s i�ehalf under this Deed of Trust or the Related ❑ocuments is fa�se or �nis�eadin� in any material respect,
<br /> either now or at the t�me made v�furnished vr becomes false or misleading at ar�y time t�ereaf�er.
