- 2 - 201701402 THIRTY SEVEN AND SIXTY THREE HUNDREDTH (937.63) SQUARE FEET OR TWO TENTHS (0.02) ACRES MORE OF LESS. together with the following rights, namely, unrestricted ingress and egress under, over, and across such land for the purpose of exercising the rights herein granted, to excavate and refill ditches and trenches, and the right to clear and keep clear of trees, roots, brush, hedges, undergrowth, and other obstructions from the surface of such tracts interfering with the location, construction, inspection, repair, replacement, removal, and maintenance of such utilities. Any such utilities and appurtenances placed upon, over, and under such tracts of land shall remain the property of the Grantee and may be removed or replaced at any time. The Grantors, for themselves, their heirs, executors, administrators, successors, and assigns, hereby covenant that no buildings, fences, or structures shall be erected or permitted on said tract and that the easement herein granted shall run with the title to such tract of land and be binding upon the Grantors, their successors and assigns. The Grantee agrees to do the following: • Re -sod all disturbed areas and return to pre- construction conditions. • Pre - construction slope and grade conditions will be re- established following construction through this segment of the project. • Mature linden tree is on the property just outside of the temporary easement. Special provisions of the construction project will provide protection of the tree during construction activities. o Slopes around the tree will also be maintained during and following construction • Any sprinklers damaged during the course of construction will be repaired as soon as possible so as to minimize downtime to the system. Sprinkler repair will be at the contractor's expense. • At this time it is anticipated construction for this easement segment will take place during any three (3) week period in April, May, or June of 2017. • Construction involves the installation of 8 -inch diameter gravity sanitary sewer and an associated manhole. Temporary easements in similar situations have been utilized for stock- piling of dirt.
