There are no severance damages. <br />The Grantee agrees to do the following: <br />Section Three <br />Severance Damages <br />1701333 <br />N. Webb Rd. Sewer Extension <br />Agreement for Temporary Construction Occupancy <br />2/3 <br />Section Four <br />Remarks <br />The City shall restore the premises to grade prior to the termination of this agreement. The City <br />shall sod any disturbed areas. Furthermore, as indicated in the permanent easement document, the <br />temporary easement will fulfill all obligations as re- listed below: <br />• Re -sod all disturbed areas and return to pre- construction conditions. <br />• Pre - construction slope and grade conditions will be re- established following construction through <br />this segment of the project. <br />• Mature linden tree is on the property just outside of the temporary easement. Special provisions of <br />the construction project will provide protection of the tree during construction activities. <br />o Slopes around the tree will also be maintained during and following construction <br />• Any sprinklers damaged during the course of construction will be repaired as soon as possible so as <br />to minimize downtime to the system. Sprinkler repair will be at the contractor's expense. <br />• At this time it is anticipated construction for this easement segment will take place during any three <br />(3) week period in April, May, or June of 2017. <br />• Construction involves the installation of 8 -inch diameter gravity sanitary sewer and an associated <br />manhole. Temporary easements in similar situations have been utilized for stock - piling of dirt. <br />Section Five <br />Assignment <br />It is understood that the rights of the owner do not automatically transfer upon sale or lease of the <br />property. The City agrees to permit assignment of the rights and obligations of Owner to a subsequent <br />buyer or tenant, provided Owner obtains the City's prior written consent which City shall not unreasonably <br />withhold. <br />
