For such purpases, Trustor hereby irre�ocab�y appain�s <br /> Lender as Trusfiar's attorney--in-�'act for the purpose of making, executing, deli�ering, fling, reco�ding, and doing all <br /> other things as may be necessary ar desirable, in Lender's sole opinion, �o accvmplish �he matters referred �v in <br /> the preceding paragraph. <br /> FULL PERF�RMANCE. If Trus�or pays af�the �ndebtedness when due, �erm�nates�he �red�t line accoun�, and vth�rwise <br /> pe�forms all the ob[igations imposed upon Trustor under this Deed of Trust, Lender shall execute and deliver to T�ustee <br /> a �eques� for fuiI recon�eyance and shall execute and de�iver ta Trusto� suitab�e s�atemen#s of termination of any <br /> financing staternent on fle e�idencing Lender`s security interest in the R�n�s and the Personal Prope�ky. Any <br /> recon��yance�ee required by law shall b�paid by Trustor, if permi��ed by app�icable law. <br /> EVENTS aF DEFAULT. Trustar wil� be in d�fault under this Deed o�Trust if any of the�o1[owing happen: �A} Trustor <br /> commits fraud ar makes a ma#erial misrepres�n�ation at any time in connect�on wi�h the Gredit Ag�eement. This can <br /> include, �or exampfe, a false statement about Trustor`s income, assets, liabili�ies, or any o�her aspects o�f Trustor's <br /> financia[ condition. �B} Trustar does not meet the repayment terms o�'the Credit Agreement. ��} Trustar's action or <br /> inac��on ad�ersely affects �he colla�era[ or Lender's righ�s in the collateral. This can include, for exampfe, failure t� <br /> maintain required insur�nce, waste or destruct��e use of�he dvuelling, failure to pay taxes, death of a11 persons liable an <br /> the account, transfer of title or sale vf the dweliing, cr�a�ion af a senior lien on �he dwelling with�ut Lende�'s <br /> permission, fareclosure by the halder of another lien, or the use of funds o��he dwe���ng for proh�b�ted purposes. <br /> RI�HTS AND REMED�ES �N ❑EFAULT. If an Even�of Defau�t occurs under this Deed of Trus�, at any time thereaf�e�, <br /> Trus�ee or Lender may exercise any one or more of the following rights and remedies: <br /> Accelera�ion Upon Defaul�; Additiona� Remedies. if any Event of❑efau�t accurs as per�he terms o�the Credit <br /> Agreement secured hereby, Lender may declare all [nd�btedness secured by this De�d of Trus��o he due and <br /> payable and the same shalf �hereupon become due and payab�e w��hout any presentment, demand, protest o� <br /> notice of any kind. Therea�ter, Lender may: <br /> �a} E�ther �n persan or by agent, with or wi#hout bringing any ac�ion ar proceeding, or by a receiver <br /> appointed by a court and w�thout �egard to the adequacy of its security, en�er upon and #ake passession <br /> ��'the Property, o�any pa�t thereof, in its own name or in the name o�Trustee, and do any acts which i� <br /> deems necessary or desirable to preserve�he �alue, marketabi�ity o��entabi�ity o�the Property, or part of <br /> the Property or interest in �he Property; increase the income from �he Property or protect the security of <br /> the Praperky; and, v+ri�h vr without taking possession vf the Proper�y, sue fa� or other-wise col�ect the <br /> rents, issues and pr�fits o�the Property, including those past due and unpaid, and apply th� s�me, less <br /> costs and expenses of operation and eo![ect�on attorneys'fees, to any indebtedness s�cured by this Deed <br />
