<br /> con�rol of�he Property; {�} use, ❑perate or manage the Praperty; and �3} caIlect the Rents from the Proper�y.
<br /> Duty to Main�ain. Trustor shal� maintain �he Proper�y in tenantab�e cvndition and promptly perfarm all repairs,
<br /> replacements, and main�enance ne�essary t❑ preser�e i�s�a(ue.
<br /> Campliance lJllith Env�ronmen�a! Laws. Trusta�' represents and warrants t❑ Lender that: {'1} auring the period afi
<br /> Trus�or's awnership ❑�the Proper�y, fihere has been na use, generativn, manufac�ure, stora�e, treafiment, disposal,
<br /> releas� or �hrea�ened release o� any Hazardous Subs�ance hy any pers�n on, under, ahout o� from �he Property;
<br /> ��} Trus�or has no knowled�e of, vr reason to laelfe�e fihafi there has been, excepfi as pre�ivus[y disclosed to and

<br /> generation, manufacture, starage, treatmen�, dispvsa[, release or threatened release o�f any Ha�ardaus Substance

<br /> all applicable f�derai, stafie, and local laws, regulations and ardinances, including wifihoufi Iimitation all
<br /> En�ironmen�al Laws. Trustor authari�es Lende� and its agents t❑ enter upan �he Prope�ty ta make such
<br /> inspec�ions and tes�s, at Trustor's expense, as Lender may deem appropr.iate �a determine camp�iance of �he
<br /> Proper�y wi�h �his sectivn vf �he Deed ❑f Trust. Any inspectivns or fiests made by Lender shall be far Lender's
<br /> purpases ❑niy and shall not be cons�rued to �reate any resp�nsibility or liability on the par�❑f Lender�o Trustor or
<br /> fia any ofiher persan. The representatians and warranties cvntained herein are based ❑n Trustvr's due diligence in
<br /> tnWestigating �he Prope�ty far Hazard�us 5ubstan�es. Trus�or hereby ��} re�eases and wai�es any future claims
<br /> against Lender �Fvr �ndemnity �r �ontrilaution in fihe e�ent Trustar be�ames liab�e ��r cleanup or �ther costs under
<br /> any such laws; and t�� a�rees to indemnify, de�fend, and hald harmless Lender againsfi any and all ciaims, lvsses,
<br /> liabiliti�s, damages, penal�ies, and expenses which Lender may direc�ly❑r�ndirectly sus�ain or suffer�esulting��om

<br /> nat �he same was or shvu�d ha�e heen knawn �o Trustvr. The pra�isivns �� fih�5 sectivn of the Deed ❑f Trust,
<br /> inciuding the abliga�ion to indemnify and de�end, shall sur�i�e�he payment❑f th� Indeb�edness and the satisfactian
<br /> and recon�eyance of the �ien of this ❑eed o�Trust and shall no�be affected by Lender's acquisition of any interest

<br /> Nu�sance, 1Naste. Trustor shall not cause, cvnduc� vr permit any nuisanc� n�r commit, permit, ar suffe�r any
<br /> stripping vf vr wasfie an vr tv �the Praperty ❑r any por�ion vf the Prvperty. Vllithout limi�ing �he generality ❑f the
<br /> �aregoing, Trustor wiEl not remvve, vr grant to any oth�r party fihe right tv remv�e, any timber, min�rals �including
<br /> oii and gas}, coal, c�ay, scoria, soil, gra�e�❑r rock products withou�Lender's priar written cansent.
<br /> Remo�raE v#lmpro�ements, Trustvr shall nvt demolish vr remv�e any Imprv�ements�ram the R�al Pr�perty wi�khout
<br /> Lender's prior written consent. As a condition�o the remo�al of any lmpro�emen�s, Lender may require Trusfivr to
<br /> make ar�angements satis�a��ory �o Lender tv rep�ace such Impro�ements with Impr��emen�s of at least equal
<br /> �a�ue.
<br /> Lender's Right tv Enter. Lender and Lender's agents and rep�-esentati�es may enter upan �he Real Property at al�
<br /> reas�nable times to attend �o Lender's interests and to inspec� the Real Proper�ty for purposes v� Trustor's
<br /> compliance wifih�he fierms and condit�ans❑�F this �3eed v�Trust.
<br /> Cvmpliance with Governmenfial Requ�rements. Trus�or shall pr�mpt�y comp�y with all laws, vrdinances, and
<br /> reguiativns, nvw ❑r hereafte�- in effect, of all gv�ernmental autharities applicabie �o the use or occupancy v��he
<br /> Property, includ�ng without [imitation, �he Americans VVith Disabilities Ac�. Trus�ar may contest in govd faith any
<br /> such law, ordinance, �r regulatian and withhold c�mpliance during any pr�ceeding, including appropriate appeals,
