<br /> acknawledged by Lender in wri�ing, {a} any breach or Wiola�ivn of any En�ironmental Laws, {b} any use,
<br /> generation, manu�acture, sfiorage, trea�ment, disposal, refease or threa�ened release ❑f any Hazardous Su�s�ance
<br /> ❑n, unde�-, ahou�t ❑r from the Property by any prior ❑wners ❑r vccupants �f the Property, or 4c} any a��ua� ❑r
<br /> threatened litigatEon ❑r claims ❑�F any kind by any person rela�ing to such matters; and �3� Except as pre�iausly
<br /> disc�ased to and acknowledged by Lender in writing, {a} neither Trustor nor any tenant, contra�tor, agent❑r v�her
<br /> authoriz�d user of the Property shall use, genera-�e, manufacture, stvre, treat, dispose of vr release any Ha�ardvus

<br /> all applica�le f�deral, sta�te, and local [aws, regula�ions and ordinan�es, including wi�haut limitation ali
<br /> En�ir�nmen�al Laws. Trustor autharizes Lender and its a�enfis ta enter upan the Property fio make such
<br /> inspections and tests, at Trustor's expense, as Lender may deem appropria�e t� determine c�mpliance vf �he
<br /> Prope�ty wi�h �his secti�n �f th� Deed o-� Trust. Any inspecti�ns or �ests made by Lender sha[I be for Lend�r's
<br /> purposes only and sha11 not be canstrued tv create any responsihility or liability on the part of Lender to Trustor or-
<br /> fio any other person. Th� representations and warranties con�ained her�in are based an Trustor's due d��igence in
<br /> in�es�kigatEng ths Pr�perty ��r Hazardous Substances. Trustor herel�y {1} releases and v+rai�es any �u�ure claims
<br /> againsfi Lend�r for indemnity or contri�u�ion in �he e�ent Trust�r becames liab�e for cEeanup ❑r o�her costs under

<br /> NuisanGe. ll�aste. Trustvr shal� n�t cause, cvnduct ar permit any nuisan�e nor Gammit, permit, or su�fer any
<br /> stripping vf or waste on v� ta the Property or any portion of �the Praperty. Wifihvut limit�ng fihe generality v�the
<br /> foregoing, Trustor will no� remo�e, or grant t❑ any o�her party the righ�to remo�e, any timber, minerals �including
<br /> ❑il and gas}, coal, clay, scaria, soil, g�-a�el a�rock p�adu��s withvu�Lender's pria�-written consent.
<br /> Remv�a�v�lmpro�rements. Trustor shall not demolish or remo�e any �mprv��ments fram fihe Real P�operty without
<br /> Lender's priar writ�en consen�. As a cand�tion�a�he remo�a� of any lmpro�emen�s, Lender may require Trustor to
<br /> make arrangements sa�isfa�tvey to Lender fi❑ replace such Impra�ements with lmpro�ements ❑# at �eas� equal
<br /> �alue.
<br /> Lender's Right fo En�er. Lende� and Lender's agents and representatiWes may en�er upon the Real Proper�y a� all
<br /> r�asvnab�e times to a��end t❑ Lender's interes�s and ta inspec� �he Real Property fvr purpvses ❑f T�us�or's
<br /> �omp�ian�e with the te�-ms and canditivns af�his Deed of Trus�.
