STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth <br />the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the <br />following described improvement which will infringe upon a utility easement dedicated to the <br />Licensor: <br />To place a drainage pipe system, with a pump tank, in the easement on the west side of the <br />property addressed as 2621 West Highway 30, per the attached sketch. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the following <br />described real estate containing said utility easement to which this License Agreement shall apply: <br />LOT THREE (3), COMMERCIAL INDUSTRIAL PARK SECOND SUBDIVISION, IN THE CITY OF GRAND <br />ISLAND, HALL COUNTY, NEBRASKA AND THE EAST FIFTY FEET (E50') OF LOT TWO (2) AND THE <br />NORTHEAST SIXTY TWO AND SIXTY FIVE HUNDRETHS FEET (NE62.65') OF LOT FOUR (4); <br />COMMERCIAL INDUSTRIAL PARK SECOND SUBDIVISION, IN THE CITY OF GRAND ISLAND, HALL <br />COUNTY, NEBRASKA TOGETHER WITH THAT TRACT OF LAND DESCRIBED AS FOLLOWS: THAT <br />PART OF FRONTAGE ROAD IN COMMERICAL INDUSTRIAL PARK SECOND SUBDIVISION, <br />VACATED BY ORDINANCE NO. 6450, MORE PARTICULARLY DESCRIBED AS THAT PART OF <br />FRONTAGE ROAD ABUTTING UPON THE EAST FIFTY FEET (E50') OR FIFTEEN AND TWENTY FOUR <br />HUNDREDTHS (15.24) METERS, OF LOT TWO (2) AND ALL OF LOT THREE (3), COMMERCIAL <br />INDUSTRIAL PARK SECOND SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee <br />may construct, maintain, repair and utilize the above described improvement at the Licensee's sole <br />risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, <br />agents and independent contractors for any damage or injury that may result to said improvement.
