This RELEASE OF PRESCRIPTIVE EASEMENT ( "Release ") is executed this3( day Mahler; 2016 by SOUTHERN PUBLIC POWER DISTRICT, a public corporation and political subdivision of the State of Nebraska ( "SPPD "). RELEASE OF PRESCRIPTIVE EASEMENT 1. On or about 1940, SPPD installed an overhead power line on and across property in the SW quarter of Section 17- Township 9 North -Range 11 West & the NW quarter of Section 20- Township 9 North -Range 11 West, now owned by The Nature Conservancy. 2. This line is located approximately as shown on the attached Exhibit "A" 3. This existing line has been in place continuously for approximately 75 years and has acquired prescriptive easement rights for this property. 4. SPPD confirms that all powerline facilities referred to above will be removed from the above - referenced property by December 31, 2017 and SPPD hereby releases and quitclaims the Prescriptive Easement rights as to said property effective December 31, 2017. 5. As of December 31, 2017, SPPD will retain no interest of any kind in said property in regards to the Prescriptive Easement. Executed as of the date first written above.
