<br /> �1. Hazardous Su�stances.As used�n this 5ection 21: �a} "Hazardou.�,Suh.stance.�"are those substances
<br /> defined as toxic or hazardous substan�es,p411t�t�.nts,or�vastes by En�iranm�ntal Law and the�allowing
<br /> �ubstances:gasoline,kerosene,ather flammable or toxic pe�raleum products,toxic pestici�es and herbicides,
<br /> voiatile sQlvents, materials containing asbest��or�ormal�ieh�de, and radioa�cti�ve materia�s;�}
<br /> "Er�v�ro�►neratal Law"means federal�aws and laws of the jurisdictian where the Praperty is located that
<br /> r�late t�bealth, safety or en�ir�rrmental protecti�n; �c} "�►��virot�t�tental�`lQar�up"inclu�es any respon�e
<br /> act�on., remed�al action, or remo�at action, as defined in Environmenta�Law; and�d}an "�►�vir�o►anxental
<br /> �o�adi�ior�"means a conditian that can cause,contrilvute to, ar otherwise trig�er aa En�ixonmenta��leanup.
<br /> Borrower shall not cause or permit the presence,use,dispasa�,stora�e,or release of any�iazardou�
<br /> Substances,or threaten ta reiease any Hazardous Substa.nGes,�n or in the Praperty.Barrvwer shall nat da,
<br /> n�r allow anyone else to do,anything affecting the Prop�rty(a}that is ir��iolation of any Environmentai
<br /> Law, (b}whi�h�reates an En�ironmeatal�ondition,or(c}which,due to the presenc�,use,ar releas�of a
<br /> Hazardaus Substance,creates a condition that adversely aff�cts the�a1t�e of the Praperty.The preceding t�v4
<br /> sentences shali not apply t�the presence,u�e,or storage�n the Pr�perty of sma11 quantities of Hazaxdaus
<br /> Substances that are genera�ly recagnized to be apprapriate to narmal residential u�es and t�mai�tenance of
<br /> tbe Property(including,bu�not�imited ta,hazardaus substances in con�umer products}.
<br /> $orrower shall promptly gi�e Lender writ�en notice of�a}any in�estigation,�laim,demand, �awsuit or�ther
<br /> action by any governmentai or regulatory agency or pr�vate party invoi�ing�he Proper�y and any Hazardaus
<br /> Substance or En�ironmenta.t Law of which Borrower has actua�knowle�ge, (b)any Environmenta�
<br /> Condition, inc�uding but not limited ta,any spilling, leaking,discharg�,release or threat of release of an�
<br /> Hazardous Substan�e,and�c)any cond�tian caus�d by the presence,use or releas�of a Ha�ardous Substance
<br /> �rh�ch ad�er�ely affects the�alu�of the Froperty. If Borrower Iearns,or is natified by any governmental or
<br /> regulatory authority,or any private party,that any remo�at or ather remediation of any Hazardous Su�bstance
<br /> affecting the Property is r�ecessary,Bonower sha�l promptly take ali necessary remedia�actions in
<br /> accordance with Environmental Law,Nat�ing herein.�hail cr�ate any obliga.tion on Lender for an
<br /> En�ironmental C�eanup.
