GALLES is the <br />Successor Trustee under a Deed of Trust executed May 14, 2013 by NICHOLAS S DEAL, a <br />single person, Trustor, in which MORTGAGE ELECTRONIC REGISTRATION <br />SYSTEMS, INC., as nominee for CHARTERWEST NATIONAL BANK was named as <br />Beneficiary and U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION as Trustee, <br />and which was filed for record on May 15, 2013, as Instrument No. 201303883 in the office of <br />the Register of Deeds for Hall County, Nebraska. Said Deed of Trust was assigned by the <br />original Beneficiary, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., as <br />nominee for CHARTERWEST NATIONAL BANK, its successors and assigns to U.S. <br />BANK NATIONAL ASSOCIATION by virtue of an Assignment dated May 19, 2015 and filed <br />for record on May 26, 2015 as Instrument No. 201503409 in the office of the Register of Deeds <br />for Hall County, Nebraska. GREGORY L. GALLES was appointed Successor Trustee by <br />virtue of a Substitution of Trustee dated September 15, 2016, and recorded September 29, 2016 <br />as Instrument No. 201606451 in the office of the Register of Deeds of Hall County, Nebraska. <br />GREGORY L. GALLES, Grantor, in consideration of the sum of Eighty Nine <br />Thousand Six Hundred and 00 /100 Dollars ($89,600) and other good and valuable consideration <br />received from U.S. BANK NATIONAL ASSOCIATION, does hereby grant, bargain, sell, <br />convey and confirm unto U.S. BANK NATIONAL ASSOCIATION, (hereinafter "Grantee" <br />where appropriate), the following- described real property in Hall County, Nebraska, to wit: <br />LOT ELEVEN (11), BLOCK THREE (3), IN THE FIFTH ADDITION TO THE <br />VILLAGE OF CAIRO, HALL COUNTY, NEBRASKA <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns <br />forever. Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />1. That NICHOLAS S DEAL, as Trustor, failed to pay to Beneficiary payments which <br />were contractually due, and the Grantor, at the request of the Beneficiary, elected to <br />declare the entire unpaid principal balance, together with interest thereon at once <br />immediately due and payable. <br />2. That an Amended Notice of Default as required by §76 -1006 was filed by Grantor <br />October 6, 2016 as Instrument No. 201606661 in the office of the Register of Deeds of <br />Hall County, Nebraska. A copy of said Amended Notice of Default was thereafter <br />mailed to all parties entitled to notice, pursuant to said Deed of Trust and in compliance <br />with §76 -1008, R.R.S. Nebraska. <br />That the Trustor failed to cure the default referenced in the Amended Notice of Default <br />within 30 days after filing of the Amended Notice of Default. <br />That a Notice of Trustee's Sale was filed by Grantor on November 9, 2016 as °Instrument <br />No. 201607500 in the office of the Register of Deeds of Hall County, Nebraska. A copy <br />of said Notice of the time and place of the sale was thereafter mailed to all parties entitled <br />
