<br /> Pass�ssion and lJse. �n�il the o�currence of an Event of Default, Trus�or may ('!} remain in possession and
<br /> contro!of the Proper�y; ��} use, operate ar manage the Property; and �3} co��ect the Rents��nm the Praper�y.
<br /> ❑uty to Main�ain. Trust�r shafl main�ain the !'roper�y in good Gondition and promp�ly perf�rm a�f repairs,
<br /> replacements, and maintenance necessary to preserve its value.
<br /> Compliance With En�Eranmenta! Laws. Trus�ar represents and warran�s tfl L�nder#hat: {'�} During the p�riod of
<br /> Trustor's awnership of�he Proper�y, there has been no use, generation, manufacture, starage, treatm�n�, dispasaf,
<br /> release or threatened release of any Hazardaus 5ubstance by any person on, under, ab�ut �r �rom the P�aperty;
<br /> �2} Tru�tor has no know��dge o�, or reasan to beiie�e that there has been, excep# as pre�iausfy disclosed to and
<br /> acknowledged by Lender in wri�ing, �a) any brea�h or v�olation af any Environmental Laws, �b} any use,
<br /> generatian, manufac�ure, storage, t��atment, disposal, re�ease o�threatened r�lease of any Hazardous Subs�ance
<br /> an, under, about or f�om the Property by any p�ior owners ar occupants of the Property, or (c} any actual or
<br /> threatened litigation ar claims of any kind by any person re[ating to such matters; and �3} Except as pre�iousfy
<br /> disc�osed ta and acknowledged by L�nder in writing, �a} neither Trus�or nvr any tenant, cantractvr, agent or other
<br /> authorized user of the Property shaC� use, genera�e, manufacture, s�ore, tr�at, dispose of or releas� any Hazardous
<br /> 5ubs#ance an, under, about or from the P�operky; and {b} any such ac�i�ity shall be conducted fn �ompliance with
<br /> all appficable federal, s�ate, and Iaca1 laws, regulations and ordinances, including withvut iimi�a�ion al�
<br /> En��ronmenta� Laws. Trus�or autharizes Lender and its agents to �nter upon the Property to make such
<br /> inspections and tes�s, at Trustor's expense, as Lender may deem appropriate to determine cflmpfiance af the
<br /> Property with thi� sec�ion of the Deed of Trust. Any inspections or tests made by Lende� sha[1 b� far Lender`s
<br /> purpases only and shali no�be construed to create any responsibi�ity ar��ability on �he part�f Lender to Trustor o�
<br /> to any o�he� person. The representations and warranties conta�ned herein are based on Trustor's due dil�gence in
<br /> in�estiga��ng the Proper�y f�r Hazardaus Substances. Trustor hereby �'�} releases and wai�es any future �la�ms
<br /> agains� Lender for indemnity or con���bution in the e��nt T�-ustar becomes I�able for cfeanup o� other costs under
<br /> any such iaws; and (2} agrees to indemn�fy, defend, and hold harmless Lender aga�nst any and aEl claims, �D55B5,
<br /> l�ab�li#ies, damages, pena�ti�s, and expenses which Lender may direct�y or indirect[y sustain or suffer resulting�rom
<br /> a breach o�this section of the Deed of Trus� ar as a c�nsequence ❑f any use, generation, manufac�ure, s#orage,
<br /> disposaf, release or threatened re�ease occurring prior�o T�ustor's owne�-ship or interest in fhe Property,whether ar
<br /> no� #he same was or should have been known to Trus��r. The pro�isions of this section of�he Deed of Trus�,
<br /> including the obligation ta indemnify and defen�, shall survi�e�he payment o��he Indebtedness and the sat�sfaction
<br /> and recon�eyance of the lien of this ❑eed of Trus�and shal[ not be affected by Lender's acquisitian of any interest
<br /> in�he Proper�y,wh��her by�Forec�osure or a�h�n�v�se. .
<br /> Nuisance, Was�e. Trustor sha[1 nat cause, conduc� or permi� any nuis�nce nor comm��, permit, or su�fer any
<br /> stripping of or waste �n or to the Property o� any por�ion v�'the Property. Withouf �imiting the general��y of the
<br /> foregoing, Trus�or wil! not r�mo�e, ar grant to any vther party the right�o remo�e, any�imber, minerals �in�luding
<br /> oil and gas}, coaf, c�ay, scoria, sail, gra�el or ro�k products without L�nder's prior written consent.
<br /> Remorral of Impro�ements. Trus�or sha�f not demalish or remo�e any Impro�ements from the Rea( Proper�y without
<br /> Lender's prior writfen consent. As a candit�on to the remo�a� �f any Impro�ements, Lender may requi�e Trus�ar ta
<br /> make arrangemen�s sa�isfiae�ory �a Lender to replace such Impro�ements wi�h lmpra�ements vf a� �east equal
<br /> Walue.
<br /> Lender's Righ#to Enter. Lender and L�nder's ag�nts and representa�ives may enter upon the Rea� Property at afl
<br /> reasonable times to a�tend �o Lender's �nterests and to inspec� �he Real Property for purposes of Trustor's
<br /> compiiance with the terms and condi#ions�f#his Deed�f Trust.
<br /> Comp�iance wi�h �orrernmental Requirements. Trus#or sha11 prompt�y cvmply with all �aws, vrdinances, and
<br /> regulations, naw or hereafter En effec�, vf al� go�ernmental authorities appl�cab[e �o the use or occupancy of'the
<br /> Proper�y. T�us�or may contest fn good faith any such law, ordinance, or regulation and wi�hhoid compfiance during
<br /> any proceeding, including appropr�ate appeafs, sa Ivng as Trustor has na�ified Lender in wrifing prior to doing so
<br /> and so [ong as, in Lender's so�e opin�on, Lender's in�erests in th� Proper�y are not jeopard�zed. Lend�r may require
