<br /> Possession and Use. Untii the ❑ccurrence o� an E�en� ❑f ❑efault, Trustar may {1} remain in possessian and
<br /> �on�rol ❑�f the Froperty; {2� use, operate or manage the Properfiy; and t3} collec�the Rents firvm the Praperty.
<br /> Duty to Main�a�n. Trus�ar shall maintain the Property in tenan�alale conditian and promptly perform all repairs,
<br /> replacements, and ma�nfienance necessary fi❑ preser�e its�a�ue.
<br /> Campliance With Environmental Laws. Trus�ar represents and warrants fia Lender that: ��� During the perivd ❑f
<br /> Trustor's ownership o�the Praperty,there has I�een n❑ us�, gen�ration, manufacture, storage,trea�men�t, dispasal,
<br /> release ar threatened re�ease ❑� any Hazardous 5ubstan�e by any person ❑n, under, abaut ar from the Property;
<br /> �2} Trus�or has n❑ knawledge ❑f, ❑r �eason fio belie�e that there has been, except as pre�iously disciosed t� and
<br /> acknawledged by L�nder in writing, �a} any breach vr �ivlafiion a� any En�ironmental Laws, �b} any use,
<br /> genera�ion, manufacture, s�orage, treatmen�, dispasal, release or�hreatened release of any Hazardous Substance
<br /> an, und�r, about ❑r �rom the Property 1ay any p�-€ar owners ❑r occupants af the Prope�ty, ar ��y any actual or
<br /> �hreatened litiga�ivn vr claims ❑f any kind 1ay any person relating to such matters; and �3y Excep� as pre�iously
<br /> disclvsed�❑ and acknow��dged by Lend�r in wri�ing, �a} neifiher Trustar nor any�enant, cvntractar, agent or other
<br /> au�horized user❑f the Praperty shall use, gene�-ate, manu�facture, store, treat, dispvse af ar release any Hazardvus
<br /> 5ubsfiance on, under, ahout❑r from�he Prvperty; and ��} any such acti�i�y shall be conducted in compliance wi�h
<br /> all applicable �ederal, s�ate, and �oca[ laws, regula�ions and ordinances, including withvu� limi�ation all
<br /> En�ironmen�al Laws. Trus�ar au�horizes Lender and i�s agents �v enter upon the Proper�y �o make such
<br /> inspectians and tests, at Trus�vr's expense, as Lender may deem appropriate t� dete�mine compliance of the
<br /> Property w�th this sec�i�n vf the Deed o� Trust. Any inspec�ions vr tests made �y Lender shalf be �or Lender's
<br /> purposes anly and shall nat be canstrued t❑ �reate any responsibility o�-Eiabili�y on th� part❑f Lender t�Trustor❑r
<br /> to any other person. The represen�a�ions and wa�-ranties contained herein are based on Trustor's due diligence in
<br /> in�es�igating the Praperty �or Hazardvus Suhstances. Trustor herel�y 4�� releases and wai�es any�u�ure claims
<br /> against Lender for indemnity ❑r cvntributivn in the e�enfi Trustar becames liable fnr cleanup ar other cflsts under
<br /> any such laws; and �2� agrees�ka indemnify, defend, and hold harmless Lend�r agains�any and all claims, lasses,
<br /> liabil��ies, damages, penalties, and expenses whi�h Lender may directly or indire��ly susfiain ar suffer resufting�rom
<br /> a hreach of this section ❑f�he De�d of Trust or as a cansequence o� any use, generatian, manufacture, storage,
<br /> dispasal, release ar fihreatened release oc�urring p�ivr fio Trustvr's ownership or in�eres�t in the Property, whether or
<br /> not the same was vr should ha�e been known to Trus�or. The pr��isions o� this section v� the L�eed a� Trusfi,
<br /> including the obligation�o indemnify and de�end, shall sur�i�e th� paymen�❑f the Indeb�edness and the satisfac�ivn
<br /> and recon��yance ❑f the lien o��his ❑eed o�Trust and shall not be affected by Lender`s acquisition of any interest
<br /> in�he Proper�y,whe�her by foreclosure or otherwise.
<br /> Nuisance, 1Nas�e. Trusfior shall not cause, ��nducfi or permit any nu�san�e nor c�mmi�, perm�t, or suffer any
<br /> s�ripping ❑f ar waste vn vr fiv the Property vr any pvrfiian of the Proper�y. Withou� lim�ting the generali�y of�he
<br /> foreg�ing, Trustvr will not rema�e, ❑r grant t❑ any other party the right t� rema�e, any timber, minerals �inc�uding
<br /> ❑il and gas�, caaf, clay,scoria, soil,gravel ❑r roc�products wi�hou�Lender's prior wri�ten consen�.
<br /> Remo►ral of Impro�emen�s. Trustor shali n�t demv��sh❑r r�mo�e any Imp�-a�emen�s fram the Rea! Property withou�
<br /> Lender's prior writken consent. As a �ondi�ion t❑�he remo�a� of any lmpra�ements, Lender may require Trustor to
<br /> make arrangements sa�isfact�ry t❑ Lender �o replace such fmp�o�ements with ImproWements vf a� �east equal
<br /> �afus.
<br /> L�nder's Right tv En�er. Lender and Lender's agents and representat��es may enter upon the Rea� Proper�y a� all
<br /> reasanalale �imes t� attend t❑ Lender's in�erests and �❑ inspec� the Real Property for purpases of Trustar's
<br /> compliance with�he terms and conditions o�this ❑eed af T�ust.
<br /> Compliance wi#h Ga�ernmental Requiremenfs. Trus�or shall promp�ly c�mply wi�h al! laws, ordinances, and
<br /> regulations, naw or h�reafter in e�f�ect, ❑f all go�ernmental authorities applicable to the use �r ac�upancy o��he
<br /> Property, including withvut limitattvn, �he Americans Vllifih Disalaifities Act. Trustar may confies� in gaad �aith any
<br /> such law, ordinance, or regulati�n and wi�hhald compliance during any proceeding, in��uding appropria�e appeals,
<br /> s❑ Enng as Trustor has noti�ied Lender in writing priar to doing sa and so (vng as, in Lender's sole opinion, Lender's
