Stehlik, and after being first duly sworn upon <br />oath, would hereby depose and state as follows: <br />1. I am an attorney licensed to practice law in the State of a <br />Nebraska. <br />2. I represented Chris Johnson, personal representative of the <br />Estate of Billy C. Johnson. Billy C. Johnson died, intestate, on <br />September 6, 1999, and at the time of his death was an owner of property <br />located at 212 East 9th Street, Grand Island, Hall County, Nebraska, <br />legally described as follows, to wit: <br />The East Half of Lot Six (6), Block One Forty -one (141), <br />Union Pacific Railway Company's Second, Grand Island, Hall <br />County, Nebraska <br />3. Billy C. Johnson was divorced from Grace C. Johnson pursuant <br />to a decree of the District Court of Hall County, Nebraska, filed of <br />record May 7, 1962. In this Decree of Dissolution, the real estate above <br />described was awarded to the defendant, Billy C. 70In3on. In the degree, <br />the court awarded to the defendant, Billy C. Johnson, "all of the real <br />estate, including the business building and the home . . . ". Any charges <br />against the real estate (i.e. property judgment, alimony, etc.) were all <br />paid and the proper receipts filed of record in the divorce proceeding. <br />The decree, however, did not provide a legal description for said real <br />estate. <br />4. On July 14, 1966, an Order Nunc Pro Tunc was entered by the <br />District Court of Hall County, Nebraska, wherein the real estate was more <br />specifically described. The real estate above described was specifically <br />listed as having been awarded to the defendant, Billy C. Johnson. The <br />Nunc Pro Tunc Order, duly signed by district judge, Donna Weaver, was <br />filed of record September 5, 1966. <br />5. In light of the foregoing, the real estate above described was <br />duly awarded to, and became the sole property of, Billy C.
