FLOWAGE EASEMENT 200004203 Oo For and in consideration of $ / Dollar (s), the receipt whereof is hereby acknowledged. Melvin E. Zichek and Dorothy V. Zichek, husband and wife of Grand Island, Nebraska, herein called the Grantor, whether one or more, does hereby grant, convey and release unto Hall County District #82, Northwest High School of Grand Island, Nebraska, herein called the Grantee, its successors and assigns, a perpetual easement in, over and upon the following described land situated in the County of Hall, State of Nebraska, to wit: A strip of land 15 feet (east & west) wide by 425 feet (North & South) in length (0.15 acre). Said strip begins at the south edge extending north 425 feet and is 755 feet east of the west boundary of the S '/2 SE '/a NE 1/4 Section 2, T -11 -N, R -10 -W, Hall County, Nebraska. (Reference attached photo.) For the purpose of installing a pipeline to convey waters from the Northwest High School property to the City of Grand Island drainageway. Said pipeline will be placed approximately five feet below ground surface with a minimum of 36 inches of earth over the pipeline. The rights and privileges herein granted shall be subject to the following terms and conditions: 1. The consideration recited herein shall constitute payment in full for all damages sustained or to be sustained by the Grantor by reason of the exercise of any of the rights or activities granted or described by the above. 2. In the event construction on the above described works of improvement is not commenced within 60 months from the date hereof, the rights and privileges herein granted shall at once revert to and become the property of the Grantor, his heirs and assigns. 3. There is reserved to the Grantor, his heirs and assigns, the right and privilege to use the above described land of the Grantor at any time, in any manner and for the purpose not inconsistent with the full use and enjoyment by the Grantee, its successors and assigns, of the right and privilege herein granted. 4. The Grantee is responsible for operating and maintaining the above described works of improvements. 5. This easement shall not pass nor shall the same be construed to pass, to the Grantee any fee simple interest or title to the above described lands.
