FLOWAGE EASEMENT 200004203 <br />Oo <br />For and in consideration of $ / Dollar (s), the receipt whereof is hereby <br />acknowledged. <br />Melvin E. Zichek and Dorothy V. Zichek, husband and wife <br />of Grand Island, Nebraska, herein called the Grantor, whether one or more, does hereby grant, convey and <br />release unto <br />Hall County District #82, Northwest High School <br />of Grand Island, Nebraska, herein called the Grantee, its successors and assigns, a perpetual easement in, <br />over and upon the following described land situated in the County of Hall, State of Nebraska, to wit: <br />A strip of land 15 feet (east & west) wide by 425 feet (North & South) in length (0.15 acre). Said <br />strip begins at the south edge extending north 425 feet and is 755 feet east of the west boundary <br />of the S '/2 SE '/a NE 1/4 Section 2, T -11 -N, R -10 -W, Hall County, Nebraska. (Reference attached <br />photo.) <br />For the purpose of installing a pipeline to convey waters from the Northwest High School property to the <br />City of Grand Island drainageway. Said pipeline will be placed approximately five feet below ground <br />surface with a minimum of 36 inches of earth over the pipeline. <br />The rights and privileges herein granted shall be subject to the following terms and conditions: <br />1. The consideration recited herein shall constitute payment in full for all damages sustained or to <br />be sustained by the Grantor by reason of the exercise of any of the rights or activities granted <br />or described by the above. <br />2. In the event construction on the above described works of improvement is not commenced <br />within 60 months from the date hereof, the rights and privileges herein granted shall at once <br />revert to and become the property of the Grantor, his heirs and assigns. <br />3. There is reserved to the Grantor, his heirs and assigns, the right and privilege to use the above <br />described land of the Grantor at any time, in any manner and for the purpose not inconsistent <br />with the full use and enjoyment by the Grantee, its successors and assigns, of the right and <br />privilege herein granted. <br />4. The Grantee is responsible for operating and maintaining the above described works of <br />improvements. <br />5.
