200004192 <br />NOTICE OF DEFAULT <br />The undersigned, Arend R. Baack, Attorney, Trustee under a certain Deed of Trust dated <br />February 17, 1995, wherein William J. Elder and Marilyn E. Elder, Husband and Wife, were the <br />Trustors, which was filed for record in the office of the Register of Deeds of Hall County, <br />Nebraska, on February 17, 1995, as Document No. 95-100928, which contains as part of the trust <br />property therein described, the following- described real estate which has not been released from <br />such Deed of Trust: <br />The South Ninety One (91) Feet of Lot Five (5) Block Eight (8) Original Town <br />Now City of Grand Island, Hall County, Nebraska <br />together with all improvements now or hereafter erected on the property, and easements, <br />appurtenances, fixtures now or hereafter a part of the property, including all replacements and <br />additions thereto, which were referred to in such Deed of Trust as the Property ", hereby gives <br />notice of default of said Trustors for the reason that the said Trustors, William J. Elder and <br />Marilyn E. Elder, Husband and Wife, have failed to make the payments of principal and interest <br />due in respect to the Adjustable Rate Note as modified by a Loan Modification Agreement <br />secured by the Deed of Trust. <br />By reason of such default, the undersigned Trustee hereby elects to sell or cause to be <br />sold the above real estate to satisfy the obligations of that certain Adjustable Rate Note dated <br />February 17, 1995, as amended by a Loan Modification Agreement dated October 7, 1999, <br />owing from Trustors to the Beneficiary , Home Federal Savings and Loan Association of Grand <br />Island, pursuant to the terms of the Deed of Trust referred to above which secures this obli ation. <br />g <br />a� <br />State of Nebraska ) Arend R.
