2� 1 ��8379 <br /> house, sorority house, room�ng house, hosp�ta�, san��arium, nursing home, rest home, <br /> trai�er park, trailer court, mobile home park or re�reationa� vehicle park ar by a <br /> �ooperative h�using corporatiian �as defined in Sect�an 216�b�(1� of the �ode}; <br /> �g� that on�e available for occupancy each Dwelling Unit in the Proje�t must <br /> be r�nted or available for rental on a con�inuous bas�s t� members �f the general public <br /> an a nontransient basis (e�cept far transitional h�using for the home�ess or sing�e-ro�m <br /> occupan�y un�ts provided under Section 42(i}(3)(B}(ii�� and �iv} of the �ode} far the <br /> �ualified Proj ect Peri�d; <br /> �h} that the D�ve���ng Un�ts �n th� Proj�ct shall be leased and rented to <br /> members of the general pub�ic in campliance with the ��de and th�s Agreem�nt, except <br /> far any units ren�ed under the h�using program pursuant to Section 8 of the United 5tates <br /> H�using A�t of 1937, as amended, which �vi1l be leased to eligible tenants ir� accordar�ce <br /> with the constraints and r�gulations of such housing pr�gram; <br /> �i} that the Project shall consist of one nr more pr��imate buildings �r <br /> structures lflcated on a single tract of �and which have similar�y constructed units <br /> financed pursuan� to a common plan �unless �he Pr�jec� qua�ifies as a scattered site <br /> project under Section 42�g}(7} �f the �ode}, together vvith functianally related and <br /> subordinate facilities which shall be owned by the �wner or a Related Person; <br /> �j� that the �wner sha11 n�t discr�minate on the basis of race, creed, ca��r, <br /> sex, se�ua� pref�rence, age, handicap, mar�tal sta�us, nat�ona� �r�g�n, familial status, <br /> source of income �r disability in the Iease, use or occupanc� of the Proj�ct or in <br /> employment of persons for the operati�n and management of the Project; <br /> �k� that the �wner will accept as tenants, an the same basis as aII other <br /> prospect�ve tenants, persons who are holders of vouchers or certificates for federal <br /> housing assistance payments for e�isting housing pursuant Co Se�tion 8 of the <br /> United Stat�s Housing Act of 1937 �r a successor federa� program, and, �n �onnection <br /> therewith, the �wner will not ap�ly tenant selection �riteria to such �oucher or cer�ificate <br /> ho�ders which are more burdensome than the criteria app�ied to an� other prospecti�� <br /> tenants; <br /> ��} that the ��vner wil� not discr�minate agair�st prospective tenants on �he <br /> basis af their reGeipt of, or el�gi�i�ity for, h�using assistance under any federal, state ar <br /> local program or�n the basis that they have a min�r child�r children living�vith them; <br /> �m� that th� �wner will not knowingly take or permi� t� b� �aken any action <br /> which �v�uld have the effect, direc�Iy or indirec��y, af subjecting the ��vner af the Praject <br /> to n�ncomp�iance �vith Section 42 of the Code and the Regu�atiar�s; <br /> (n� �hat the �vvner �1} wiii n�t dispose to any person any por�i�n of the <br /> Pr�ject to which this Agreement applies un�ess al� of the Projec� is dispos�d of to such <br /> person and (2} may sell, transfer or e�change the entire Prajec� at any time, but the <br /> �wner shal� notify in �vriting and obta�n the agreement of any buyer or success�r or o�her <br /> person. acquiring the Project or any int�rest therein that such acquisit�on �s subjec� to the <br /> requirements of this Agreement. The ��vner shall promptly natiify the Authority af such <br />
