2� 1 ��8379 <br /> tenant faci�ities that are avai�able on a comparable basis to all tenants and for <br /> vvhich no separate fee is charged for use of the faci�ities ar faci�ities reasonab�y <br /> required by the proje�t}; <br /> �e} that the Autharity shall hav� the right to perform an an-site inspection of <br /> the Praject thraughout the Qua�ified Project Period, in addit�on to the requirement that the <br /> �vvner submit ta the Author�ty ea�h year informat�on �n tenant income, suppor�ing <br /> d�cumentati�n and rent for each �ua�ifi�d Unit as designated above; <br /> �f� the form of �ease to b� used �y the �wner �n ren�ing any un�ts in the <br /> Proj ect to �ualified Tenants sha�l provide for term�nat�on nf the lease and consent �y <br /> such person t� �mmediate e�iction procee�iings in acc�rdance with stat� Ia�v f�r fa��ure to <br /> qual�fy as a Quaiif�ed Tenant, as appl�cable, as a result af any materia� m�srepresentation <br /> made by such person with respect to his or h�r inc�me, the failure to pr�vide supporting <br /> income verificat�on �r fa�lure by such person to annual�y update the �ertification �f <br /> Tenan�Eligibility and Income Verification; <br /> (g} to permit any du�� autharized representative of �he Authority, the <br /> Department of the Treasury or the IRS to inspect the books and records of the ��vner <br /> p�r�aining t�the incomes �f the �ual�fied Tenants residing in the Praj e��; and <br /> �h) throughout the �ualif�ed Praject P�riod, ta target rents, to comp�y with <br /> targeted rent �evels and t� comp�y all other cond�tions af target�ng as se� forth an the <br /> Summary Page hereof. <br /> Section 5. Term of Restrict�ons. <br /> �a} The term of the �ccupancy Restriction set f�rth in Section 4 of this <br /> Agreement sha1� (�} cammence an the �ccupancy Date and �ii} end �n the date �vhich �s <br /> the Requir�d Number of Years after the �ccupancy Date. During the Required Num�er <br /> flf Years, the ��vner shall not ev�ct ar terminate the tenancy of an e�isting tenant �f any <br /> D�velling Unit ather than for good cause and shall not increase the gross rent above the <br /> maximum allovved und�r Section 42 �f the Cade with respect to such Dwelling Unit <br /> �b� Not�vithstand�ng subsection �a} above, the �vvner shal� comply �vith the <br /> requirem�nts of 5ectian 42�h� of the Code r�lat�ng to a 15--year extended use peri�d <br /> �3� �ears tota�}; pravided, hovvever, that, with respect to any bui�ding that is part of the <br /> Project, this Agreement sha11 terminate: <br /> (1� on the date such building is acquired �y foreclosure or instrument <br /> in �ieu of farec�osure �including a deed of trust}; or <br /> [2} after the e�piration of the �ual�fied �ontract Required Number of <br /> Years, if �he �wner has praperly requ�sted �n a�cordance wi�h �ode <br /> Sec�i�n 4Z�h}�d} that the Au�hority assist in pro�uring a qualified con�ra�t for �he <br /> acquisition af the low-incom�port�on of su�h building and the Authority is unable <br /> �o �resent a qualifiec� c�ntract one year after �he date the writt�n request was <br /> subm�t�ed to the Authority. <br />
