(f) <br />(g) <br />2 01607889 <br />Shall not use any part of Grantor's real estate outside of the Levee Easement and <br />Temporary Easement areas for any purpose including ingress and egress, storage, <br />or any construction activity. <br />Shall insure that final grade in the Temporary Easement area and the Levee <br />Easement area south of the Levee slopes away from the substation fence. <br />(h) Upon completion of the project, will cause all construction equipment, <br />construction materials, and foreign materials of whatever kind or description not a <br />part of the completed project to be removed from Grantor's real estate. <br />3. Obligations of Grantor. Grantor, its heirs, successors and assigns, <br />(a) Shall have the right to install powerline facilities in and across the Levee <br />Easement and Temporary Easement, provided that such facilities do not interfere <br />significantly with the operation or maintenance of the Levee system. In the case <br />of an unresolvable dispute between Grantor and Grantee over any such facility <br />installation, resolution of the dispute will be mediated by an independent third - <br />party registered Civil Engineer whose fee will be paid by Grantee. Grantor shall <br />give Grantee at least thirty days' written notice of the intent to install any facilities <br />prior to commencing any such installation. <br />(b) Shall not allow any non - powerline related structures, buildings, or other property, <br />or obstruction or fences of any kind whatsoever, to be erected, constructed, <br />placed, stored or accumulated in, up, above, along, over, across, or through the <br />Levee Easement herein granted without written permission of Grantee. <br />(c) Shall not disrupt or remove soil, farm, or change Levee Easement area elevations <br />without written permission of Grantee. <br />4. Permitted Uses for Temporary Easements. The Temporary Easement may be <br />utilized by the Grantee, its agents, employees, licensees, contractors, subcontractors and their <br />employees, for the purposes of ingress, egress, construction equipment operation and soil <br />removal as necessary for construction, and to otherwise facilitate Grantee's construction. <br />5. Termination of Temporary Easements. The Temporary Easement shall terminate <br />upon the completion of the above - referenced construction of the flood control levee and any <br />3 <br />
