WITNESSETH: <br />• <br />E <br />1 <br />P. <br />Tract: 5 — Southern NE Rural Public Power District <br />Project: Silver Creek Levee Improvements <br />EASEMENT AGREEMENT <br />This Easement Agreement made and executed this 9 T day of �, , / , 2016, by <br />and between Southern Public Power District, hereinafter referred to as Grantor ", and Central <br />Platte Natural Resources District, a Nebraska Political Subdivision, hereinafter referred to as <br />"Grantee ". <br />WHEREAS, Grantor is the owner in fee simple of that real estate generally described as: <br />A tract of land in the Northeast Quarter of the Northeast Quarter (NE1 /4 NE1 /4) of <br />Section Three (3) Township Eleven (11) North, Range Ten (10) West of the_6`h P.M., in <br />Hall County, Nebraska, as recorded on the 9th day of June, 1971 in Book 164, Page 409, <br />in the office of the Register of Deeds of Hall County, Nebraska; and <br />WHEREAS, Grantee seeks to obtain a permanent easement for improvement, operation, <br />maintenance, and repair of an earthen levee along Silver Creek over and upon a portion of such <br />Grantor's real estate; and <br />WHEREAS, during the course of the construction of the levee improvements, the <br />Grantee will need to obtain a temporary construction easement over and upon a portion of <br />Grantor's real estate; and <br />WHEREAS, Grantor is willing to grant such Easements to the Grantee, its successors and <br />assigns subject to the performance of the obligations stated herein; <br />
