<br /> Beneficiary. The word "Beneficsary" means Fi�e Points gank, and its successors and assigns.
<br /> Borrower. The word "Borrvwer" means J�N M MYERS and CHANDRA L MYERS and in�ludes all co-signers and
<br /> ca-makers signing the No�e and all �heir success�rs and assigns.
<br /> Deed af Trust. The words "C]eed ❑f Trust" mean this ❑eed of Trust among Trust�r, Lender, and Trustee, and
<br /> includes without iimitation all assignmen� and security interest pro�is�ons relating to the Persanal Proper�y and
<br /> Rents.
<br /> Default. The ward "Default" m�ans the D�fault set forth in this Deed af Trust in rh� s�ction titled "D�fault".
<br /> Environmental Laws. Th� words "En�ironmental Laws" mean any and all state, federal and Ivcal statutes,
<br /> regulations and ordinances r�lating ta th� pr�tection of human health ❑r the en�irt�nment, inc�uding without
<br /> limitation the Comprehensi�e En�ironmenta� Respvnse, Compensation, and Liability Act of 1980, as amended, 42
<br /> IJ.S.C. 5ection ���1, et seq. �"CERCLA"�, the Superfund Amendments and Reautharizativn Act a� 198�, Pub. L.
<br /> No. 99-499 �"SARA"}, the Hazardaus Materials Transportation Act, 49 U.S.C. 5ection 18�1, e�s�q., the Resource
<br /> Cvnser�ation and Reco�ery Act, 42 U.S.C. Section 69�1, et seq., or other applicable state vr #ederal laws, rules,
<br /> or regu�atians adnpted pursuant thereta.
<br /> E�ent of De�auit. The words "E�ent vf Default" mean any of the e�ents af defauit set farth in this Deed ❑f Trust in
<br /> the e�ents af default section�f this Deed af Trust.
<br /> Existing Indehtedness. The words "Existing Indebtedness" mean the indehtedness d�scribed in the Existing Liens
<br /> provisivn of this ❑eed ❑f Ttust.
<br /> Guaranty. The word "Guaranty" means the guaranty fram guarantar, endarser, surety, ar accvmmadation party to
<br /> Lender, including without limitativn a guaranty of all �r part❑f the Nate.
<br /> Hazardnus Suhs�ances. The words "Hazardous Substances" m�an materials that, because af theEr quantity,
<br /> �on�entratian or physical, Ghemical ar intectivus �haracteristicsr may cause or pase a present or potential hazard
<br /> to human h�aith or the en�ironment when impraperly used, treated, stored, dispvsed ❑f, generated, manufaGtured,
<br /> transported or otherwise handled. The wards "Hazardous Substan�es" are used in their ��ry brvadest s�nse and
<br /> inciude without limitation any and a�� hazardous or taxic substances, materia�s or waste as defined by or }isted
<br /> under the En�iranmental Laws. The term "Hazard�us 5ubs�an�es" als❑ includes, wEthvut limitatian, petroleum and
<br /> �etroleum by-products ar any fra�tion therevf and asbestos.
<br /> Impro�ernents. The word "�m�ro�ements" means al! existing and future impro�emen�s, bui��lings, structures,
<br /> mabile hvmes af�ixed on the Real Praperty, fa�ilities, additions, replaG�ments and flther constructian on the Real
<br /> Property.
<br /> Indebtedness. The word "Indebtedness" means all principal, interest, and ❑ther amounts, casts and exp�nses
<br /> payable under the Nate or R�lated Documents, together with all renewals ❑f, �xtensians vf, modificatians af,
<br /> cvnso��dat�vns of and substitutions far the Not� or Related Documents and any amounts expended ar ad�anced by
<br /> Lender ta discharge Trustor's obl�gativns or expenses incurred by Trustee ❑r Lender to en�orce Trustor's
<br /> abligativns under this ❑eed vt Trust, togeth�r wi�h interest on such amvunts as pro�ided in this Deed ❑f Trust.

<br /> Lender. The w�rd "Lender" means Fi�e Po�nts Bank, its sucGessars and assigns.

<br /> Persanai Property. The words "Personal Property" mean a!! equipment, fixtures, and ather articles of persona�
<br /> property n�►rv or hereafter ❑wned by Trustor, and nnw ar h�reafter atta�hed or affixed to the R�al Praper�y;
<br /> t�gether with all accessivns, parts, and additians ta, all replacements ❑f, and all substitutions for, any of such
<br /> property; and t�gether with all proceeds �including without limitativn a!I insurance praceeds and refunds a#
<br /> premiums� �rom any sale or o�her disposition vf the Praperty.
<br /> Property. The word "Praperty" means colle�ti�eiy the Real Property and the P�rsvnal Praperty.
<br /> R�al Property. The words "Real Proper�y" mean �he real property, int�rests and rights, as turther described in this
