201607705 RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS In consideration of the mutual benefits to be derived by the Owners hereinafter described and any purchaser or purchasers, their heirs, devisees, personal representatives, successors, assigns or grantees, the Owners hereinafter described stipulate and agree that all of Lots described on Exhibit "A" attached hereto and incorporated herein by reference that are currently owned or are sold, transferred or conveyed, shall be and are subject to the following restrictive covenants, restrictions and conditions. All restrictive covenants, restrictions and conditions shall run with the land and are as follows: 1. This DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES HOMEOWNERS' ASSOCIATION (North Road and Grouse Boulevard) shall apply to the Lots described on Exhibit "A" attached hereto and incorporated herein by reference. 2. The following definitions shall apply to this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES HOMEOWNERS' ASSOCIATION (North Road and Grouse Boulevard): a. "Association" shall mean the homeowners' association to be formed by the Incorporator to be known under the name of "North Road/Grouse Boulevard HOA of Summerfield Estates" or such other name as selected by Incorporator and his successors and assigns. b. "Owner" shall mean an owner of a Lot described on Exhibit "A" attached hereto and incorporated herein by reference who executes an addendum attached hereto and incorporated herein by reference and "Owners" shall mean the owners of the Lots described on Exhibit "A" attached hereto and incorporated herein by reference who execute an addendum attached hereto and incorporated herein by reference. c. "Properties" shall mean and refer to the Lots described on Exhibit "A" attached hereto and incorporated herein by reference. d. "Lot" shall mean and refer to any platted lot of land as described on Exhibit "A" attached hereto and incorporated herein by reference. 3. Every Owner of a Lot within the Properties shall be a member of the Association. Membership in the Association is a condition of ownership of any Lot within the Properties. Membership shall be appurtenant to and may not be separated from ownership of any Lot which is subject to assessment. The Association shall have one class of voting membership which shall be and include the Owner of each Lot contained in the Properties.
