201607705 <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />In consideration of the mutual benefits to be derived by the Owners hereinafter described <br />and any purchaser or purchasers, their heirs, devisees, personal representatives, successors, <br />assigns or grantees, the Owners hereinafter described stipulate and agree that all of Lots <br />described on Exhibit "A" attached hereto and incorporated herein by reference that are currently <br />owned or are sold, transferred or conveyed, shall be and are subject to the following restrictive <br />covenants, restrictions and conditions. All restrictive covenants, restrictions and conditions shall <br />run with the land and are as follows: <br />1. This DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND <br />CONDITIONS FOR SUMMERFIELD ESTATES HOMEOWNERS' ASSOCIATION (North <br />Road and Grouse Boulevard) shall apply to the Lots described on Exhibit "A" attached hereto <br />and incorporated herein by reference. <br />2. The following definitions shall apply to this DECLARATION OF RESTRICTIVE <br />COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES <br />HOMEOWNERS' ASSOCIATION (North Road and Grouse Boulevard): <br />a. "Association" shall mean the homeowners' association to be formed by <br />the Incorporator to be known under the name of "North Road/Grouse Boulevard <br />HOA of Summerfield Estates" or such other name as selected by Incorporator and <br />his successors and assigns. <br />b. "Owner" shall mean an owner of a Lot described on Exhibit "A" <br />attached hereto and incorporated herein by reference who executes an addendum <br />attached hereto and incorporated herein by reference and "Owners" shall mean the <br />owners of the Lots described on Exhibit "A" attached hereto and incorporated <br />herein by reference who execute an addendum attached hereto and incorporated <br />herein by reference. <br />c. "Properties" shall mean and refer to the Lots described on Exhibit "A" <br />attached hereto and incorporated herein by reference. <br />d. "Lot" shall mean and refer to any platted lot of land as described on <br />Exhibit "A" attached hereto and incorporated herein by reference. <br />3. Every Owner of a Lot within the Properties shall be a member of the Association. <br />Membership in the Association is a condition of ownership of any Lot within the Properties. <br />Membership shall be appurtenant to and may not be separated from ownership of any Lot which <br />is subject to assessment. The Association shall have one class of voting membership which shall <br />be and include the Owner of each Lot contained in the Properties. When more than one (1) <br />person holds an interest in any Lot contained within the Properties, all such persons shall be <br />
