<br />Santana Avila and Jenaro Martinez Hernandez, wife and husband, ( "TRUSTORS "), whose
<br />mailing address is: P.O. Box 2172, Grand Island, Nebraska, 68802 -2172; and, Jamie Mues
<br />Jankovitz, Attorney at Law ( "TRUSTEE "), whose mailing address is: 202 W. 3rd St., P.O. Box
<br />639, Grand Island, Nebraska 68802 -0639; and DT HOMES, LLC, by Trenton A. Lilienthal,
<br />Vice- President, whose mailing address is P.O. Box 2172, Grand Island, Nebraska, 68802 -2172,
<br />( "BENEFICIARY ").
<br />FOR VALUABLE CONSIDERATION, Trustors irrevocably transfer, convey, and
<br />assign to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of •
<br />Beneficiary, under and subject to the terms and conditions of this Deed of Trust, the real
<br />property located in Hall County, Nebraska, and legally described as follows:
<br />The Southerly 66 feet of Fractional Lots 1 and 2, in Fractional Bock 38, in Charles Wasmer's
<br />Addition to the City of Grand Island, Nebraska and its complement being Fractional Lot 1, in
<br />Fractional Block 3, in Windolph's Addition to the City of Grand Island, Nebraska, and being
<br />a rectangular tract of ground having an easterly frontage of 66 feet on Adams Street, a depth
<br />of 106 feet and bounded on the south by the alley in said Blocks 3 and 38, as surveyed, platted
<br />and recorded. Subject to easements, conditions, restrictions and limitations of record.

<br />TOGETHER WITH all rents, easements, appurtenances, hereditaments, interests in
<br />adjoining roads situated thereon.
<br />The property and the entire estate and interest conveyed to the Trustee are referred to
<br />collectively as the "Trust Estate ".
<br />FOR THE PURPOSE OF SECURING:
<br />(a) Payment of indebtedness of the total principal amount of $45,000.00
<br />with interest thereon at the rate of 5.00 % per annum, as evidenced by a Promissory
<br />Note of even date (the "Note ") with a maturity date of November 15, 2021, executed
<br />by Trustor, which has been delivered and is payable to the order of Beneficiary, and
<br />which by this reference is hereby made a part hereof, and any and all modifications,
<br />extensions and renewals thereof.
<br />(b) Payment of all sums advanced by Beneficiary to protect the Trust Estate,
<br />with interest thereon at the rate of 5.00 % percent per annum, the default rate:
<br />This Deed of Trust, the Note, and any other instrument given to evidence or further
<br />secure the payment and performance of any obligation secured hereby are referred to collectively
<br />as the "Loan Instruments ".
<br />TO PROTECT THE SECURITY OF THIS DEED OF TRUST:
<br />1. PAYMENT OF INDEBTEDNESS. Trustors shall pay when due the
<br />principal of, and the interest on, the indebtedness evidenced by the Note, charges, fees and all
<br />other sums as provided in the Loan Instruments.
<br />2. REAL ESTATE TAXES. Trustors shall pay the annual real estate taxes to
<br />the Hall County Treasurer before the taxes become delinquent and shall furnish tax receipts to
<br />Beneficiary on or before May 1st and September 1st each year.
