1. I am an attorney licensed to practice law in the State of Nebraska. I am the agent for, <br />and I represent, the Continental Gardens Homeowners Association. <br />2. Pursuant to an Amended Declaration, found at Document #95- 108944 in the office <br />of the Register of Deeds of Hall County, Nebraska, the Continental Gardens Homeowners <br />Association ( "the Association ") has the right to make assessments against property located in <br />Continental Gardens. <br />3. Pursuant to Article VIII, paragraph 9, captioned "Notice of Lien ", the Association is <br />entitled to a lien on any property for failure to pay assessments: <br />"9. Notice of Lien. At any time any assessment becomes more than thirty <br />(30) days past due, the Association or its agents may file of record an <br />affidavit stating the facts relative thereto, which affidavit shall serve as public <br />notice of the existence of the lien, and that the lien shall also cover unpaid <br />assessments which accrue after the date of the filing of the lien. No purchaser <br />or mortgage holder who does not have personal or public notice of the lien <br />shall be subject thereto and the lien shall not be foreclosed where any such <br />bona fide purchaser or mortgagee has an interest of record in said lot." <br />4. This document shall serve as the Affidavit of the agent of the Association stating that <br />as of the date hereof, the following described property is subject to past due assessments in the <br />amount of $489.16. This lien not only covers the past due assessments in said amounts, but also <br />covers unpaid assessments which accrue after the date of the filing of this lien. <br />Lot Eleven (11), Block Seven (7), Unit Two (2), Continental Gardens, Grand <br />Island, Hall County, Nebraska. <br />AND FURTHER AFFIANT SAITH NOT. <br />glen E.
