200004084 <br />-15- <br />in any other appropriate filing or recording office. The mailing address of Trustor is the address of <br />Trustor set forth at the end of this Deed of Trust and the address of Beneficiary from which <br />information concerning the security interests hereunder may be obtained is the address of <br />Beneficiary set forth in the first paragraph of the first page of this Deed of Trust. <br />ARTICLE 7 <br />Miscellaneous <br />7.1 Binding g ffect. All of the terms, covenants and conditions of this Deed of Trust <br />shall bind Trustor and its respective heirs, devisees, administrators, executors, successors and assigns <br />and shall inure to the benefit of and be available to Beneficiary, and its successors and assigns. <br />7.2 Interpretation, Time of the Essence. All references to Trustor and Beneficiary <br />shall be read in the singular or plural and in the masculine, feminine or neuter gender, as the sentence <br />may require. Time is of the essence with respect to each and every obligation of Trustor under the <br />Notes, the Deed of Trust and the other Loan Documents. <br />7.3 Governing Law. This Deed of Trust shall be governed by the laws of the State <br />or Commonwealth in which the Premises are located. In the event that any provision of this Deed <br />of Trust conflicts with applicable law, such conflict shall not affect other provisions of this Deed of <br />Trust or the Notes which can be given affect without the conflicting provisions, and to this end the <br />provisions of this Deed of Trust are declared to be severable. <br />7.4 Covenants Run With Land. All of the covenants of this Deed of Trust shall run <br />with the land constituting the Premises. <br />7.5 Headings. The headings to the articles and sections hereof are for reference only <br />and do not limit in any way the content thereof. <br />7.6 Additional Assurances. Trustor hereby agrees to promptly execute and deliver <br />such further instruments and assurances and will do such further acts as Beneficiary may reasonably <br />request to perfect the security interest of Beneficiary in all or any portion of the Premises and/or to <br />more effectively carry out the purposes of the Notes, Deed of Trust and /or other Loan Documents. <br />7.7 Future Advances. The parties hereto intend and agree that this Deed of Trust shall <br />secure (i) any indebtedness arising under any line of credit or revolving credit plan and (ii) unpaid <br />balances of any loan advances, whether obligatory or not, made by Beneficiary after this Deed of <br />Trust is delivered to the County Clerk, Register of Deeds or Recorder's Office for record to the <br />extent that the total unpaid indebtedness, exclusive of interest thereon, does not exceed the maximum <br />LEASEHOLD DEED OF TRUST 692960.5 <br />
