Box 639 <br />Grand Island, NE 68802 -0639 <br />AFFIDAVIT OF HEIRS <br />COMES NOW, the following are the sole heirs and children of Evelyn A. Layher, Joni Scheibe, <br />daughter, and Cynthia K. Lindley, daughter and Attorney in Fact, being of lawful age and sound mind, and <br />having been first duly sworn, state the following: <br />1. Cynthia K. Lindley, is the duly authorized and acting Attorney -in -Fact for Evelyn A. Layher, <br />principal, under a written Power of Attorney dated July 18, 2014. <br />2. Said principal is the owner of the property described herein: <br />Lot Two (2), Block Twenty Five (25), Russel Wheeler's Addition to the City of <br />Grand Island, Hall County, Nebraska. (Physical address: 307 W. 11 St.) <br />3. Said Power of Attorney authorizes Cynthia K. Lindley, to act on behalf of the principal for the <br />purpose of selling the property described herein, and to execute all instruments necessary in the performance of <br />said authority. <br />4. The Affiants are the sole surviving children of Evelyn A. Layher, and therefore would be entitled to <br />all of the residual assets of her Estate. <br />5. The Affiants know of no other testamentary provision or Last Will and Testament lawfully executed <br />by Evelyn A. Layher that vests an interest in any other individual or entity other than Cynthia K. Lindley and <br />Joni Scheibe. <br />6. Affiants fully understand and agree to the sale of the above referenced property in the amount of <br />$100,000.00 to Cynthia K. Lindley. <br />7. Affiants understand and hereby acknowledge the authority of Cynthia K. Lindley, as Attorney in Fact <br />for Evelyn A. Layher, to execute any and all documents, including but not limited to a Purchase Agreement and <br />Deed, in order to sell the property described herein to Cynthia K. Lindley. <br />8. This Affidavit is given for the express purpose of closing on the sale of the above referenced real <br />estate to Cynthia K. Lindley. <br />Cynthi K.
