Maser <br />Maser Law, LLC <br />1,,/123 North Locust Street, Suite 201 B <br />P.O.Box 1151 <br />Grand Island, Nebraska 68801 <br />PERMANENT ACCESS EASEMENT <br />RECITALS <br />AGREEMENT <br />CO <br />THIS PERMANENT ACCESS EASEMENT (this "Easement ") is made and entered into <br />as of the ?j) day of January, 2016, by and between Bosselman Two, LLC ( "Grantor") and <br />Five Points Bank, a Nebraska banking corporation ( "Grantee "). <br />A. Grantor is the owner of certain real property legally described on Exhibit "A" <br />attached hereto and incorporated herein by reference (the "Grantor Property "). <br />B. Grantee is the owner of certain real property legally described on Exhibit "B" <br />attached hereto and incorporated herein by reference (the "Grantee Property "). <br />C. The Grantor Property is immediately adjacent to the Grantee Property. <br />D. Grantor and Grantee by this instrument intend to create a non - exclusive <br />easement of right -of -way for ingress and egress over the that portion of the Grantor Property <br />described herein (the "Easement Area "), for the benefit of Grantee, according to the terms and <br />conditions set forth herein. <br />For and in consideration of the mutual promises hereinafter set forth and other good and <br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged, and <br />intending to be legally bound, the parties hereby agree and covenant with each other the <br />following: <br />1. Easement Area. The term "Easement Area" shall mean a forty foot (40') wide <br />strip of the Grantor Property running along the western boundary of that portion of the Grantee <br />Property described as Parcel 1 and Parcel 2 in Exhibit "B ", then taking a ninety degree (90 °) <br />
