201606758 <br />of six hundred twenty five and ninety three hundredths (625.93) feet to a point on <br />the northerly right -of -way line of the Union Pacific Railroad; thence S58 °02'40 "W, <br />along the northerly right -of -way line of said Union Pacific Railroad, a distance of <br />eight hundred eighty two and sixty hundredths (882.60) feet, thence <br />N31°56'41"W, a distance of ten (10.0) feet to the ACTUAL Point of Beginning; <br />thence N58 °02'40 "E, parallel with the northerly right -of -way line of said Union <br />Pacific Railroad, a distance of thirty (30.0) feet; thence N31°56'41"W, a distance <br />of five hundred sixty and twenty four hundredths (560.24) feet; thence <br />N 1 °31'20' W, a distance of fifty one and ten hundredths (51.10) feet; thence <br />S42 °51'56 "E, a distance of sixty nine and forty nine hundredths (69.49) feet to <br />the point of termination. <br />The above easement and right of way containing a combined total of 0.33 acres, <br />more or less, as shown on the plat dated 9/7/2016, marked Exhibit "A" attached <br />hereto and incorporated herein by reference. <br />Together with the following rights: <br />Grantee shall have unrestricted ingress and egress to the above - described <br />easement and right -of -way for any purpose necessary for the surveying, construction, <br />inspection, maintenance, repair, replacement, relocation, extension, removal, and <br />operation of such public utilities and appurtenances. Such rights of ingress and egress <br />shall be exercised in a reasonable manner. <br />Grantee shall have the right to excavate and refill ditches and trenches <br />necessary for such public utilities and appurtenances; to remove, clear, and keep clear, <br />trees, bushes, hedges, undergrowth, and /or any other obstructions interfering with the <br />surveying, construction, inspection, maintenance, repair, replacement, relocation, <br />extension, removal, and operation of such public utilities and appurtenances. <br />Grantee shall have the right at any time, to relocate, add, or upgrade such public <br />utilities and appurtenances connected therewith, in, upon, above, along, over, across, <br />underneath, or through the easement and right -of -way herein granted. Any such public <br />utilities and appurtenances placed in, upon, above, along, over, across, underneath, or <br />through such tract of land shall remain the property of Grantee, and may be removed or <br />replaced at any time. <br />[2] <br />
