<br /> Z 1. Hazarr�ous 5ub�tances. As used in ��'115 5ection 21: �a} "Hazardous Substances" are those Sl.lUS�SiiCeS
<br /> defined as toxic or hazardous substances, pallutan�s, or wastes by Environmental Law and the fol�awing
<br /> substances: gasoline, kerosene, other flammable or toxic petroleum products, �oxic pesticides and herbicides,
<br /> �olati�e sol�ents, materials conta�ning asbestos or forma�dehyde, and radioacti�e materials; (b}
<br /> "Errvironmerz�al Law" means federal laws and laws vf the jurisdiction where the Property is located that
<br /> relate to health, safety or en�ironmental protec�ion; (c} "Lrrvironmental Cleartup" includes any response
<br /> activn, remedial action, or remo�al action, as defined in En�ironmental Law; and (d� an "Errvrronmental
<br /> �ondition" means a condition that can cause, con�ribute to, or otherwise trigger an En�ironmental�leanup.
<br /> Borrawer shall nat �ause vr permit �he presence, use, disposai, storage, or release of any Hazardous
<br /> Substances, or threaten to relea.se any Hazardous Substarices, on or in the Fraperty. Barrower shal� not do,
<br /> nor a�low anyone else to da, anything affecting the Property (a} that is in violation of any En�ir�nmental
<br /> Law, �b} which creates an En�ironmental Gondition, �r (c} which, due to the presence, use, or release vf a
<br /> Hazardous SuhstanGe, creates a condition tha� ad�ers�ly affects the �aiue of the Property. The preceding two
<br /> senten�es shall nat apply ta �he presence, use, or storage on the Property �f small quanti�ies of Hazardaus
<br /> Substan�es �hat are generaity recognized to be appropriate to normal residentia� uses and to maintenan�e of
<br /> �he Praperty(including, hut not limited to, hazardous substan�es in consumer products}.
<br /> Borrower sha�l promptly gi�e Lender written not�ce of(a}any in�estigation, claim, demand, lawsuit or ather
<br /> action by any governmental or regu�atory a�ency or pri�ate party in�o��ing the Property and any Hazardous
<br /> Substance ar En�ironmental Law of which Borrower has actual knowiedge, �b} any En�ironmental
<br /> Conditior�, including bu� not limited ta, any spilling, teaking, discharge, release or threat vf release of any
<br /> Hazardous 5ubstance, and(�}any condition caused by the presence, use or rel�ase of a Hazardous Substance
<br /> which ad�erse�y affects the �alue of th� Property. If Barrower learns, or is notified by any go�ernmental or
<br /> regulatory autharity, or any pri�ate party, that any remo�al or other remediation of any Hazardous Suhstance
<br /> affecting the Property is ne�essary, Borrower shail promptly take all necessary remedial actions tn
<br /> accordance with En�ironmental Law. Nothing herein shali create any obtigation an Lender for an
<br /> En�ironmental Cleanup.
<br /> Non-Uniform Co�enants. Borrower and Lender�o�enant and agree as fol�ows:
<br /> 22. Accelerat�on; F�emedies. Lender sha�l gi�e notice ta Borrower prior to acceleration fo�lawing
<br /> Borrower's breach af any co�enant or agreement in �his Securtty Instrument �but not pr�or to
<br /> acceleration under Section 1S unless Applicab�e Law pra�ides ath�rwi�e). The natice sha�l specify: �a}
<br /> the def�uit; �b) the action required to cure the default; (c} a date, not less than 34 days from the date
<br /> the natice �s gi�en to Borrower, by which the default must be cured; and �d} that failure to cure the
<br /> def�u�t on vr before the date specified in the notice m�y result En �eeeleration of the sums se�ured by
<br /> this Security Instrument and sale of the Property. The natice shal� Further inform Borrower of the
<br /> right to reinst�te after acceleration and the right to bring a court act�on to assert the non-existence of a
<br /> deFault or any other deFense of Barrower to a�ceieratioa and sale. If the defau�t i� not cured on or
<br /> before the date specified in the natice, Lender at it5 option may require immediate payment in fu�l of
<br /> all sums secured by th�s Security Instrument w�thout further demand and may in�oke the power�f sa�e
<br /> and any other remedies permitted by Applic�b�e Law. Lender shall be entitled to eollect all expenses
<br /> incurred in pursu�ng the remedies pra�ided in th�s Seetion ZZ, iacluding, but nat limited ta, reasonable
<br /> at#orneys' fee�and�osts of title e�idence.
