<br /> En�irflnmen�al Laws. Trustor aufiha�izes Lender ar�d i�s agen�s to enter upon the Property ta make such
<br /> inspections and tests, at Trustar's expense, as Lender may deem appropriate to determine complian�e vf the
<br /> Property with this seCti�n of th� Deed of Trust. Any inspec�ians ar tes�s made by Lender shall be �or Lende�'s
<br /> purpases ❑nly and shall not �e construed to create any responsibili�y �r liability on th� part ofi Lender t� Trustor vr
<br /> t� any other person. The representations and warranties cantained herein are bas�d on T�ustor's due diligence in
<br /> in�estigat�ng the Proper�y f�r Ha�ardous Substances. Trustor hereby ��y releases and wa��es any fu#ure claims
<br /> against Lender �or indemnity or contribufiion in the e�ent Trustor hecomes liable far c�eanup or other cos�s under
<br /> any su�h laws; and t�� agrees to indemnify, defend, and hQld harmless Lender against any and all claims, losses,
<br /> liabi�ities, damages, penaltfes, and expenses whi�h Lender may direc�ly�r indirectly sustain or suffer resul�ing from
<br /> a breach of this section of the Deed o� Trust or as a consequence of any use, generat�on, manufac�ure, storage,
<br /> disposal, release or thr�atened �e�ease ❑�curring privr�v Trus�vr's own�rship or inter�st in the Property, whether❑�
<br /> not the same was or shou�d ha�e �een knawn �o Trus�vr. The pro�isions �f this section of the Deed of T�ust,
<br /> inc�uding�he obligatian ta indemnify and defend, shall sur�i�e the paym�nt o�the Indehtedness and the satis�action
<br /> and recon�eyance ❑f the I�en ��this Deed of Trus�and shall n�t t�� affected �y Lend�r's acquisi�ion of any interest
<br /> in the Proper�y, whether by�oreclasure or otherwise.
<br /> Nuisance, INaste. TrustQ� shal� no� cause, conduct or permit any nuisance nor commit, permi�, �r suf��r any
<br /> stripp�ng a# or waste on or to the Property ar any portian of �he Property. Without limiting the generality of the
<br /> f�regoing, Trus�ar will no� r�m�W�, or grant to any �ther party the �ight to remo�e, any timber, minerals �including
<br /> oil and gas}, coal, clay, scaria, soil, gra�e�o�rvck products wi�hout Lender`s prior written consent.
<br /> Remv�al of lmpro�emen�s. Trustor sha(i not demolish❑r remo�e any impro�ements from the Real Proper�y wi�hout
<br /> Lendsr's prior written consent. As a conditi�n�a �he rema�a! ❑f any Impra�emen�s, L�nder may require Trus�or to
<br /> make arrangements satisfac�ory to Lend�r to r�plac� such lmp�o�ements ►n�ith Impr��ements o� at least �qual
<br /> �alue.
<br /> Lender`s Right to Enter. Lender and Lender's agents and r�presentat��es may enter upon the Real Property a� all
<br /> reasonable times to attend to Lender's in�erests and ta inspect th� Reai Property for purp�ses o� Trustor's
<br /> compliance with th�terms and conditions of this D�ed of Trust.
<br /> Compliance wi�h Go�ernmenta� Requirements. Trustor shall pr�mptly comp�y with all laws, ardinances, and
<br /> regu�atians, now or her�a�ter in e��ect, of all go�ernmental au�horities appli�ab#� �o the use ar ticcupan�y o� the
<br /> Property, including without fimitat�on, the Amer�cans With Disabili�ies Ac�. Trustor may contest in good faith any
<br /> su�h law, ordinance, ar regula�ion and withhold Gompl�ance during any proceeding, in�luding apprapriate appeafs,
<br /> so long as Trustor has notified Lender in wri�ting prior to doing sv and so long as, in Lender's sofe opinion, Lender's
<br /> interes�s in �he Property are not jeopardiz�d. Lender may r�qu��e Trusto� to post adequa�e se�ur�ty or a 5ure�y
<br /> hond, reasonabfy satisfacto�y to Lender, �o pratect Lender's int�r�st.
<br /> Du#y to Protect. Trust�r ag��es n�ithe� to abandon or lea�e unattended the Property. Trus�or shalf d❑ all other
<br /> acts, in addifiion to those acts set forth aba�e in this section, whi�h�rom the character and use�f the Prope�ty are
<br /> reasonably necessary to protect and preser�e the Property.
<br /> DUE aN SALE -CONSENT BY LENDER. Lender may, at Lender's option, de�lare immediate[y due and payable al! sums
<br /> secured by this �eed af Trus�upvn the sale or trans�er, w�thout Lender's prior wri�ten consent, o�a�l or any part of the
<br /> Real Property, or any interest in the Real Property. A "sa�� ar t�ansfer'" means �he �on�eyance o� Rea1 Praper�y or any
<br /> right, title �r interest in �he Real Property; whether legal, hene�ic�a� or equitable; whether �oluntary a� in�aluntary;
<br /> whether by outright sale, deed, installment sale con�rac�, land contra�t, contract for deed, feasehald interest with a
<br /> term greater than three 437 yea�s, lease-option contrac�, or �y sale, assignment, or trans�fer of any �eneficia( interest in
<br /> or to any land trus� holding title t� the Real Praper�y, or by any other method of con�eyan�e of an in�erest in the Real
<br /> Pr�perty. I� any Trus�or is a corporat�on, partnership ar limi�ed �iabili�y c�mpany, trans#er also in�ludes any change in
<br /> awnership af mvre than twen#y-fi�e percent ��5°/0} of�he �vting s�ock, par�nership interests or limited liabili�y company
<br /> �nterests, as the case may be, of suGh Trustar. Howe�e�, th�s optian shall not be exercised by Lender if such exercis�
<br /> is prohibi�ed by federa� �aw or by Nebraska law.
<br /> TAXES AND LtENS. The �oi�owing pro�isions rela�ing to �he taxes and liens on the Property are part a� this Deed of
<br /> Trust;
<br /> Payment. Trustor shall pay when due �and in al� e��nts p�ior tv delinquen�yy all taxes, specia��axes, assessments,
<br /> charges �inc(ud�ng water and sewery, �ines and impositions le�ied against or on ac�ount of the Property, and shall
<br /> pay when du� ail claims for work done an or f�r ser�ices rendered or material furnished #o th� Prap�rty. Trus�ar
<br /> shall main�ain fihe Property free v�a!! liens ha�ing priari�y o�er❑r equaf to�he interest�f Lender under this D�ed of
<br /> Trust, except for the li�n af taxes and assessments not du� and except as otherwise pra�ided in this Deed of
<br /> Trust.
<br /> Right ta�ontest. Trustor may wi�hhold payment�f any tax, assessment, or claim in connection with a good fai�h
<br /> d�spufie aWer the obfigation�o pay, s❑ long as Lender's in�er�st in the Property is not jeapardi�ed. if a lien a�ises or
<br /> is f�1ed as a result of nonpayment, Trustor shall wi�hin �i��een ��5} days after the lien a�ises or, if a lien is f�led,
<br /> within �iffieen t 15} days after Trustar has noti�e of the filing, secure �he discharge o� the lien, or if request�d �y
<br /> Lender, d�pos�t with Lender cash or a suffici�nt c�rporate surety bond or a�her securi�y satisfactory to Lender in an
<br /> amoun�sufficient to discharge�he lien plus any costs and attorneys' �ees, or other charges that could accrue as a
<br /> result of a foreclasure or sale under the lien. In any contest, Trustor sha��defend i�tself and Lender and shall sa�isfy
<br /> any ad�erse�udgment be�ore en�orcement against the Praperty. Trustor shal! name Lender as an additional obligee
<br /> under any sure�y bond furnished in the contes� proceedings.
<br /> E�idence vf Payment. Trust�r shall upan demand furn�sh �o Lender satisfac�ory e�idence o�f paymenf �f the taxes
<br /> or ass�ssments and shall au�horize the apprapriate go�ernmental official to deli�er tv Lender at any �ime a writ�en
<br /> statemen�of the taxes and assessments against the Prnperty.
<br /> Notice o�Cvnstruction. Trustor shall noti�y Lender a� leas� fifteen �15f days b�fore any work is c�mmenc�d, any
<br /> ser�iGes are �urnished, or any materials are supplied to the Property, if any mechanic's I�en, materialmen's I�en, or
<br /> oth�r li�n could be assert�d on acc�unt o� the wark, ser�ices, or ma�erials. Trustor wi�� upon request of Lender
<br /> furnish to Lender ad�anc� assurances satis�actory t❑ Lender tha� Trus��r can and will pay the cost of su�h
<br /> impro�emen�ks.
<br /> PRQPERTY DAMA�E INSURANCE. Th� following pro�isions re�at�ng to insuring the Property are a part o�this Deed af
<br /> Trust.
<br /> Maintenance of Insuran�e. Trustor shall procure and maintain polici�s ❑� ���e insuran�e with standard extended
<br /> co�erage endorsements on a replacement basis for the full �nsurabl� �alue co�ering a!� lmpra�ements on the Real
<br /> Property in an amount su��ic�ent �ta a�aid appli�ation af any cainsurance clause, and with a standard mortgagee
<br /> cfause in fa�or of Lend�r. Trustor shall alsa procure and maintain comprehensi�� gene�al liahility insuranc� in su�h
<br /> C��erage amounts as Lender may request with Trustee and �ender being named as additional insureds in such
<br /> liabif�ty insurance policies. Additionally, Trustar shall main�ain such other insurance, inc�uding but no� limited to
<br /> hazard, l�usiness interruptian, and bo��er insurance, as Lender may r�as�nably require. Po��cies shall be written �n �
