I�Trus�ar pays afl the Indeb�edness when due, �erminates the credit line account, and o#herw�se <br /> performs all the obligations imposed up�n Trus�ar under this Deed o�Trus�, Lender shall ex�cu�e and deli�er to Trus�ee <br /> a request for fu�i recon�eyance and shal� execu�e and deliver t� Trus�ar suita�le statements o� �ermination af any <br /> finan�ing statemen� on file e�iden�ing Lender's securi�y interest �n the Rents and the Persona! Property. Any <br /> recon�eyance fee requ�red by law shall be paid by Trustor, if permitfed by app�icabfe Iaw. <br /> EVENTS �F DEFALILT. Trus�or w�ll be �n default und�r this Deed of Trust ifi any�f the follawing happen: �A} Trus�or <br /> commi�s fraud or makes a material m�srepresentation a� any �ime in connec�ivn with the Credit Agreement. This can <br /> include, �or exampfe, a false statement abaut Trustar's income, assets, l�ab�lifies, or any other aspects of Trustor's <br /> �inancial condit�on, (B} Trustor does not meet the repayment terms of the Credit Agreement. �C) Trustar's action or <br /> inactian adversefy affec�s the colla�eral or Lender's rights in the c��iateral. This can inc�ude, for example, �ailure to <br /> maintain required insurance, wasfe or destructive use of the dwell�ng, failure ta pay taxes, death of afl pe�sons l�ab�e on <br /> the accoun�, ��ansfer of titie or sale of the dwelling, creativn of a senio� �ien on the dwelling withau� Lender's <br /> permission, foreclosure by the ho�der of another lien, ar the use of funds or the dwelling�or prahibi�ed purposes. <br /> RI�HTS AND REMEDIES �N DEFA�LT. �f an Event of Default oceurs under this Deed of Trust, at any time thereafter, <br /> Trustee or Lender may exercise any one o�more of the fofCowing righ#s and remedi�s: <br /> Acceierat�on Upon Defau�t; Additionai Remedies. �f any Event o�F De�ault occurs as per the terms of the Credit <br /> Agreemen�secured hereby, Lender may declare a1f In�ebtedness se�ured by�his Deed o�F Trust�o �e due and <br /> payabie and�he same sha�l thereupon become due and payab�e wi�hout any presenfinent, d�mand, pratest or <br /> no�ice of any kind. Thereafter, Lender may: <br /> �a} Eith�r in person or by agen�, with or without bringing any act�on ❑r proceeding, or by a receiver <br /> appainted by a cour� and withau� regard to the adequacy of��s security, enter upon and take possessiQn <br /> af th� Property, or any pa�t thereaf, in its own nam� or in the name of T�ustee, and do any acts which it <br /> d�ems necessary or desirable to preserve the �a�ue, marke�ability or rentabi�ity of�he Prop�rty, or part o€ <br /> the Property or �nteres� in the Prop�rty; increase the incame from �he Property or pratec��he securfty of <br /> the P�-operty; and, wi�h ar w�thout taking passessi�n of the Property, sue �'vr or othen�v�se collec� the <br /> rents, issues and profi�s of the Property, including �hose past due and unpaid, and apply the same, less <br /> costs and expenses of operatian and col��ction attorneys'fees, to any ind�btedness secured by this Deed <br /> ❑f Trus�, a�l in such order as L�nder may de�ermine.
