<br /> business flr the death of any member, the insol�ency of Trustor, the app�intment o� a recei�er #or any part of
<br /> Trus�or's property, any assignment for the henefit af creditors, any type of credi�or workou�, ar �he
<br /> commen�ement af any praceeding under any bankrupt�y or insol�ency laws by ar against Trustor.
<br /> Creditor or Forfeiture Proceedings. Gammencement vf f�recfosure ar for�eiture pro�eedings, whether by judicial
<br /> proceed�ng, self-h�ip, reposssssion or any o�her method, hy any credi�or v�Trustor ar by any go�ernmental agency
<br /> against any prap�rty securing the [ndebtedness. This inc[ud�s a garn�shmen� o� any of Trustor's accvun�s,
<br /> including deposit acGounts, wi�h Lender. Hawe�er, this Event of Default sha11 not apply if there is a gaod faith
<br /> dispute by Trustor as to the �alidity or reasonab�eness of the claim which is the basis of the creditar or ��rfei�ure
<br /> proc�eding and i� Trustor gi�es L�nd�r writ�en noti�e of the cr�ditor or forfei�ure p�oceeding and deposits wi�h
<br /> Lender monies or a surety bond for�he creditor vr forfeiture proceeding, in an amount determined by Lender, in its
<br /> sole d�scretion, as being an adequate reser�e or bond for the dispu�e.
<br /> Breach v#�th�r Agreement. Any hreach by Trustor under the �erms o�any ather agreem�nt b�tween Trustor and
<br /> Lender that is na� r�medied wi�h�n any grace periad p�o��ded therein, including withvut limitation any agreement
<br /> �an�erning any ind�btedness or other obligation of Trustor to Lender, whe�her ex�sting now or later,
<br /> E�en�s Affecting Guarantor. Any �f the preceding e�ents occurs with respect to any Guarant�r v� any af the
<br /> lndeb�edness or any Guarantor dies or becomes �ncampetent, or revokes or disputes th� �alidity ❑f, �r �iability
<br /> under, any Guaranty o#the Indebtedness.
<br /> AdWerse Change. A material ad�erse change oc�u�s in Trusto�'s financia{ condi�ion, a� L�nder belie�es th�
<br /> prospect of payment ar per�armance❑fi the Lndebtedness is impa�red.
<br /> Insecurity. Lender in gaod faith belie�es itself insecure.
<br /> Right to Cure. If any de�ault, other than a defau�t in payment, is curable and �f Trustor has not been given a nv�ice
<br /> of a brea�h o#the same pro�ision o#�his ���d of Trust within�he pr�ceding twel�e �1�} months, i�may be cured if
<br /> Trustor, aft�r Lende�sends written notice to Trus�or demanding cure ❑f such d��ault: {1 y cu�es the de�ault with�n
<br /> twenty ���} days; or 4�y i� the cure requires more than �wenty {2Df days, immediateiy ini�iates steps which
<br /> �ender deems in Lender's soie discretion �❑ be su�ficient �o cure the default and thereaft�r con�inues and
<br /> completes all reasonable and necessary steps suf€ic�ent�o produce compliance as soon as reas�nably pracfiical.
<br /> RIGHTS AND REMEDIES �N DEFAULT. I� an E�en� o� Default occurs under�his Deed o�Trus�, at any time thereaf�er,
<br /> Trus�e�or Lend�r may exercise any ane ar more of the following righ�s and remedies:
<br /> Ac�eleration Upan Default; Additianal Remedies. If any E�ent o� �efault accurs as per #he terms o#the Note
<br /> secured hereby, Lender may declare a�� Indeb�edness secured k�y this Deed of Trust to be du� and payable and
<br /> the same sha�l thereupan f�ecome due and payab�� without any presentment, demand, pro�est or natice�f any
<br /> kind. Therea�ter, Lender may;
<br /> 4ay Either in person or by agent, with or wi�hout bringing any actian or p�o�eeding, or by a r�cei�er
<br /> appointed by a court and withou� regard to the adequacy of its security, enter upon and take p�ssession
<br /> af the Property, or any part thereof, in its own name ❑r �n the nam� of Trustee, and do any acts which it
<br /> deems nec�ssary or desira#�fe ta preser�e the�afue, marketability or rentability af the Property, ar part af
<br /> the Property or in�erest in the Property; increase the in��me frvm the Proper�y ❑r protec�th� securi�y of
<br /> the Property; and, with or without �aking possessivn of the Praperty, sue for or otherwise callect the
<br /> rents, issues and pra�its af�he Property, including �hose past due and unpaid, and apply the same, less
<br /> costs and expenses o�opera�ion and collect�on attorneys" ��es, ta any indeb�edness secur�d hy this Deed
<br /> o� Trust, af� in such �rder as Lender may determine. The �ntering upon and �aking possession of �he
<br /> Proper�y, the collection of such rents, issues and profits, and the appli�a�ion thereof sha�i no� cure o�
<br /> wai�e any default or notice o�defaul� under this Deed o�Trust or in�alida�e any act done in �esponse to
<br /> such default or pursuan��o such no�ice o�default; and, no�wi�hstanding�he continuance in possess�on of
<br /> the P�oper�y or �he collection, receipt and application of rents, issues or pro�its, Trustee or Lender shall
<br /> be entitled t❑ exercise e�ery right pr��ided for in �he No€e ar�he Related Documents or �y 1aw upon the

<br /> and election ta cause Trustor's interes� in�he Proper�y t� be sold, wh�ch no�ice Trustee shall cause to be
<br /> duly filed for record in the apprapriate offices of�he Cvunty in which the Property is Ivcated; and
<br /> �d} VVith respect to all ❑r any par�t of�he P�rsanal Praperty, Lender shall have a�� the rights and remedies
<br /> �f a secured party under�he Ne#�raska Un�form Commercial C�d�.
<br /> Foreclosure by Pnwer of Sale. l�Lender elects ta foreclose by exercise o�the Power of 5ale herein con�ained,
<br /> Lender shall na�ify T�ustee and shall depos€t wi�h Trustee this Deed of Trust and the Note and such receipts
<br /> and evidence of expendi�ur�s made and secured by�his Deed of Trust as Trustee may require.

<br /> the Property at the time and place o� sale fixed by it in such Noti�e o� Sale, eithe� as a whoie, ar in
<br /> s�parate �o�s or parcels o� items as Trustee shall de�m expedient, and in such order as it may determine,
<br /> a� publi� auction to th� highest bidd�r far cash in lawful mon�y of the Unit�d 5tates payable at rhe �ime
<br /> �f sa�e. Trustee shall del��er to such purchaser or purchasers �hsreo� its good and sufficient deed or
