<br /> such�vnsent is required and in all cases such cansent may be granted or withheld in the sole dis�retion of Lender.
<br /> Se�erability. !fi a �ourt vf competent jurisdi�tion finds any pra�ision ❑f this ❑eed of Trust to be illegal� in�alid, ��
<br /> unenforceahle as to any pet�son or circumstance, that fiinding shall not make the offending pro�ision illega�, in�alid,
<br /> or unenforceable as t❑ any other persvn or circumstance. If feas+ble, �he offending pro�ision shall he considered
<br /> mvdified so that it becomes legal. �alid and enfvr�eable. If the ofifending prv�ision �ann�t be s❑ mvdified, �t shall

<br /> DEFINITI�NS. Th��ollowing capita�ized words and te�ms shall ha�e the follawing meanings when used in this ❑eed of
<br /> Trust. Unless speci#ically stat��!to the cvntrary. a�� references tv dollar amounts shall mean amounts in lawful m�ney
<br /> of the United 5tates of Amer�ca. Words and terms used in the singular shall include the plural, and the plural shall
<br /> include the singular, as ths context may require. Words and t�rms no� otherwise defined in ihis D�ed af Trust shall
<br /> ha��the meanings attrik�uted tv such te�ms in the Uniform Gommercial Cod�:
<br /> Benefici�ry. Ths word "B�nefic�ary" means Exchange Bank, and its successors and assigns.
<br /> Bvrrawer. The word "Borrower" means HARTMANN HAY ��., LLC and includes all co-signers and co-makers
<br /> signing the Note and a�1 th�ir successors and assigns.
<br /> Deed of Trust. The wvrds "Deed vf Trus#" m�an this Deed ❑f Trust among Trustor. Lender, and T�ustee. and
<br /> includes without I�mitation al! assignment and security interest pro►►ision� retating���v �#�� Persana! Property and
<br /> Rents.
<br /> Defau�t. The ward "Default" means the aefault set forth in this Deed vf Trust in the�sectivn titled "Default".
<br /> En�ironmental L�ws. The words "En�ironmenta� Laws" mean any and a11 state, federal and ioca! statutes,
<br /> regu�ations and ❑rdinanc�s r�iating tv the prvtection of human hea�th ar the en�ironmsnt, including wi�hout

<br /> Event of Default. The words "E►►ent of❑efault" mean any vf the e�ents of default set forth in this Deed of Trust in

<br /> Existing Indebt�dness. The vuords "Existing Indebtedness" mean the indehtedness described in the Exist�ng Liens
<br /> pro�isian af this Deed❑f Trust.
<br /> Guaranty. The ward "Guaranty" means the guaranty from guarantor, endarser� surety. or accvmmodation party to
<br /> Lender, including without limitati�n a guaranty of all or part vf the Note.
<br /> Hazerdous Substances. The r►vords "Hazardous 5ubstances" mean mate�ials that, because vf their quant�ty,
<br /> concentration vr physical, chemical or infectivus characteristics, may �ause or pase a prss�nt vr potential hazard
<br /> to human health or the en�ironment when improperly used. tr�ated, stored, disposed of, �enerated, manufa�tured,
<br /> transpvrted or atherwise handled. The wards "Hazard�us Suhstances" are used in their �ery broadest sense and
<br /> include wi�haut �imitatian any and all haza�dous ar toxic su#�stances. mat�rials or waste as defined by o� I�sted
<br /> under the En�ironmental Laws. The term "'Hazardous Substances" als�includes. without limitatian, petro�eum and
<br /> petroleum by-products or any fra�tivn thereof and asbestos.
<br /> Impro►►emen#s. The word "Impro�ements" means all existing and future impro�ements, buildings. structures,
<br /> mok�ile hames affixed on the Real Prvperty, facilities, additivns, replacem�nts and other constructian on the Real
<br /> Prvperty.
<br /> Indeb#edness. The word "�ndebtedness" m�ans al1 principal, interest. and o�her amounts. costs and expenses
<br /> payable under the Nate vr Related D�cuments, toge#her with al� renewals of. extensions af, modifications of,
<br /> c�nsolidations of and substitutions fvr the Nvte vr Related Documents and any amvunts expended vr ad�anced by
<br /> Lender t� discharg� Trustor's obligativns or expenses incurred hy Trust�e or Lender t❑ en#or�e Trustor's
<br /> obligations under this Deed vf Trust, together with interest on such amvun#s as prv►►ided in this Deed❑f Trust.
<br /> Lender. The ward "Lender" means Exchange Bank, its successors and assigns.
<br /> Note. The word "No#e" means all past, present and future notes. Ivans or oth�r obligativns of the horrvwer,
<br /> N�TICE T�TRUST�R: THE N�TE��NTAINS A VARIABLE INTEREST RATE.
<br /> Persona� Property. The wards "Personal P�operty" mean a�l equipment, fixtures, and other articles ❑f persvnal
<br /> property now ar hereafter owned hy Trustvr. and nvw or hereafter attached or af#ixed tv the Real Prap�rty;
<br /> together with all accessions, parts, and additions to, all replacemen#s of� and all substitutions for, any of such
<br /> property: and together with all proceeds �including without limitati�n al# insurance proc��ds and refunds of
<br /> premiums� from any sale or o#h�r dispasition of the Property.
<br /> Property. The word "Property" means coilecti�ely the Real Property and the Persvnal Property.
<br /> Real Property. The words "Real Property" mean the real property, interests and rights, as further d�scribed En this
<br /> ❑eed of Trust.
