<br /> No Wai�er by Lender. Lender sha�l not be deemed to have wai�ed any rights under this Deed of Trus�unless such
<br /> wai�er is �i�en in wri#ing and s�gned by Lender. No delay o�r omission an the part af Lender�n exercising any righ�
<br /> shal� apera�e as a wai�er of such righ� or any other righ�. A wai�er by Lender of a pro��s�on o�this Deed of Trus�

<br /> Se�erabi���y. lf a court o��ompetent jurisd�ction f�nds any pro�ision of this Deed af Trust�o be ilfegal, in�alid, or
<br /> unenforceab�e as �a any circums�ance, that fiinding shal� no� make the affending pro�ision 't((egaf, in�alid, ar
<br /> unenforceab�e as to any other circumstance. If feasible, the offending pravision shall be �onsidered m�dified so

<br /> DEFINITI�NS. The following capitali�ed words and terms shal� ha�e the fol�owing meanings when used in this Deed of
<br /> Trust. Llnless spe�ifica�ly stated �o the cnntrary, all refer�nces to dalfar amounts shal! mean amaunts in lawfui money
<br /> of the Uni�ed States of Ameri�a. Words and terms used in the singular shall include the plu�-al, and �he p�ural sha�l
<br /> include the s�ngular, as the context may require. V1lords and terms not oth�rwise defined in �his Deed of Trust sha[I
<br /> ha�e the meanings attributed�o such terms in the Un�form Commercial Code:
<br /> Beneficiary. The word "Benef�c�ary"means Access Bank, and i�s su�cessors and assigns.
<br /> Borrower. The wvrd "Borrower"means TS'�2 PHASE li LLG and includes all cv-signers and co-makers signing fhe
<br /> Nvte and a[I�heir successors and assigns.
<br /> Deed of Trust. The vuords "Deed of Trust" mean this Deed of Trust among Trusto�-, Lender, and T�ustee, and

<br /> Ren�s.
<br /> Default, The word "�e#ault"means the Defaul�set forth in this Deed of Tt-ust in the section tit�ed "Default".
<br /> Environmental Laws. The words "En�ironmental Laws" mean any and all state, federal and local statutes,
<br /> regu�ations and ordinances rela�ing t� fhe protecti�n of human hea�th ar the en�ironment, inc�uding wi�thout

<br /> Guarantar. The word "Guarantor" means any guarantor, surety, o�- accommodation par�y �f any or all of the
<br /> Indebtedness.
