Rathman died on November 11, 2015; The East Half of the Southwest Quarter (E' /2SW %) and Lot Three (3) on Island, in Section One (1), Township Ten (10) North, Range Ten (10), West of the 6th P.M., in Hall County, Nebraska; and Lot Nine (9), Westroads Estates, Third Subdivision, Grand Island, Hall County, Nebraska. CERTIFICATION OF TRUST Lawney L. Rathman, being first duly sworn upon oath, deposes and states that: 6. The Family Trust is irrevocable due to the death of the decedent, Sharleen M. Rathman and is in full force and effect; 10. The Trust Agreement including the Family Trust has not been revoked or amended to make any representation contained in this Certification of Trust incorrect and the signature of Affiant is as the Trustee under the terms of the Trust Agreement. 1. Sharleen M. Rachman created the Sharleen M. Rachman Revocable Living Trust Agreement dated March 10, 2009, (the "Trust Agreement ") wherein Sharleen M. Rachman designated Lawney L. Rachman as the initial Trustee of the Trust Agreement, Jim C. Rathman as the first successor Trustee and Jennifer L. Klanecky as the subsequent successor Trustee; 2. From the date of the creation of the Trust and continuing through the date hereof, Lawney L. Rathman has served as Trustee of the Trust; 4. The Trust Agreement is irrevocable due to the death of the decedent, Sharleen M. Rathman and is still in full force and effect; 5. Pursuant to ARTICLE VIII, Paragraph B. of the Trust Agreement, the Sharleen M. Rachman Family Trust ( "Family Trust ") was created as a result of the death of Sharleen M. Rachman and Affiant, Lawney L. Rachman is serving as Trustee of said Family Trust; 7. The terms of the Trust Agreement grant Affiant as Trustee all powers under the Nebraska Uniform Trust Code; 8. The Internal Revenue Service has issued a taxpayer identification number for the Sharleen M. Rathman Family Trust; 9. Lawney L. Rathman, surviving spouse, is the sole beneficiary of said Family Trust during his lifetime and John R. Rachman, Jim C. Rathman, Jennifer J. Klanecky and Jeffrey G. Rathman are the remainder beneficiaries of the Family Trust; and
