In the event of any conflict with the provisions of this Deed of Trust set forth above and this <br />Article 10, the provisions of this Article 10 a shall govern. <br />4837 -9099- 7551.5 <br />ARTICLE 10 <br />LOCAL LAW PROVISIONS <br />Section 10.1 Trust Deeds Act. This Deed of Trust shall constitute a trust deed under the Trust <br />Deeds Act as amended and as may be further amended from time to time. Grantor expressly <br />subjects the Mortgaged Property to such Trust Deeds Act, and Trustee and Beneficiary shall be <br />accorded all the rights, powers and remedies of a trustee and a beneficiary as provided for therein. <br />All rights, powers and remedies of the Trust Deeds Act are hereby incorporated by reference as <br />if the rights, powers and remedies were expressly provided herein, with Beneficiary as a <br />"beneficiary," Grantor as a "trustor," Trustee as a "trustee," this Deed of Trust as a "trust deed" <br />and that portion of the Mortgaged Property constituting real property as "trust property." <br />Section 10.2 Request for Notice. Grantor, for itself and for each party hereto, hereby requests <br />a copy of any notice of default and a copy of any notice of sale hereunder be mailed to them at <br />the applicable addresses provided herein <br />Section 10.3 Trustee. Trustee shall not be liable for any error of judgment or act done by <br />Trustee, or be otherwise responsible or accountable under any circumstances whatsoever. <br />Trustee shall not be personally liable in case of entry by Trustee or anyone acting by virtue of the <br />powers herein granted to Trustee upon this Deed of Trust for debts contracted or liability for <br />damages incurred in the management or operation of the Mortgaged Property. Trustee shall have <br />the right to rely on any instrument, document or signature authorizing or supporting any action <br />taken or proposed to be taken by Trustee hereunder or believed by Trustee in good faith to be <br />genuine. Trustee shall be entitled to reimbursement for expenses incurred by Trustee in the <br />performance of Trustee's duties hereunder and to reasonable compensation for such of Trustee's <br />services hereunder as shall be rendered. Grantor will, from time to time, pay compensation due <br />Trustee hereunder and reimburse Trustee for and save and hold Trustee harmless from and <br />against any and all loss, cost, liability, damage and expense whatsoever incurred by Trustee in <br />the performance of its duties. All moneys received by Trustee shall, until used or applied as <br />herein provided, be held in trust for the purposes for which they were received, but need not be <br />segregated in any manner from any other moneys (except to the extent required by law), and <br />Trustee shall be under no liability for interest on any moneys received by Trustee hereunder. <br />14 <br />201605356 <br />
