<br /> Agreement seeured hereby, Lender may declare all lndeb�edness secu�ed by this Deed of Trus�to be due and
<br /> payable and the same sha�l thereupon became due and payable withou�any presentment, demand, pro�est or
<br /> notice of any kind. Thereaf��r, Lender may:
<br /> �a} Either in person or by agent, with or without bringing any actian or proceeding, or hy a recei�er
<br /> appointed by a caur�and w�thout regard to�he adequacy af its security, ente�upon and take possessian
<br /> ❑f the Pr�perty, or any pa�k ther�of, in its own name❑r in �he name af Trustee, and do any acts which ��
<br /> deems necessary or desirab�e to preserve#he Walue, marke�ability or ren�abili�y o�the Praperty, or par�❑f

<br /> of Trus�, aif in such order as Lender may determine. The en�ering upon and taking possessian of�he
<br /> Praperty, the collection of such �en�s, issues and prafi#s, and fhe application thereof shafl no� cure or
<br /> wai�e any d�faul�or notice of defau�t under this ❑eed of Trust ar invafidate any act done in resp�nse fo
<br /> su�h default or pursuan�to such notice of de�auft; and, notwi�hs�anding�he con��nuance in p�ssession o�
<br /> �he Praperty ar the coflection, receipt and appf�cation of rents, issues or proffts, T�-us�ee or Lender shafl

<br /> �c} Deli�er ta Trustee a writ�en declaration of defau�t and demand for sale and a writ�en notice of defauft
<br /> and election to cause Trustor's interest in the Proper�y ta be sold,whi�h notice Trus�ee shalf �ause to be
<br /> dufy#ifed for recard in the appropriat�fl�fices of the County in whi�h the Prope�ty is lacated; and
<br /> (d} Wll�th respect�o alf ar any par�o�#he Persona! Praper�y, Lender shall ha�re all the rights and �-emedies
<br /> o�F a secured party under the Nehraska Unifarm Cammercial Code.
<br /> Fore�fosure hy Pawer o�Sale. lf Lender efec�s to foreclose by exerc�se of the Power o�Sale herein con�ained,
<br /> Lender shall not�fy Trustee and sha�l depasi�with Trustee this ❑eed ��Trust and the �redit Agreemen� and
<br /> such rece�pts and evidence of expendi�ures made and secured by this Deed o�Trus�as Trustee may require.
<br /> �a} Upon receipt of such na�ice from Lender,Truste�shal� �ause to be recorded, pubf�shed and deli�ered
<br /> to Tr�ustar such No�ice Q�Default and Notice of Sale as then requir�d by law and by this Deed a�Trust.
<br /> Trustee shall, without demand an Trustor, af�er such ��me as may then �e �equired by law and af�er
<br /> recordatian o�F such Nflt�ce of Default and after Notice of Sale hav�ng been given as required by[aw, sell
<br /> the Pr�oper�y at the time and p�ace af sale fixed by i� in such Notice o� Sale, either as a whole, or in
<br /> se�ara#e lots or�parce[s or items as Trustee shal� deem expedient, and in such order as it may determine,
<br /> at public auG�ian to the h�ghest bidder far cash �n lawful money of the United States payable a�the�im�
<br /> of sale. Trus#�e shall d�li��r�o su�h purchaser o� purchasers �hereof �ts gaod and suff�cien� deed o�
<br /> deeds canveying �he proper�y so sold, but wi�hout any co�enant or war�anty, express or implied. The

<br /> Trust, including costs of eviden�e of fii��e in connec�ion with sa[�,Trustee shal!appfy�he proceeds o�sale
<br /> ta paymen� o� �i} al[ sums expended under the terms af this Deed of Trust or under the terms of �he
<br /> Credi� Agreement not then repaid, including bu� no� limited ta a�crued �nterest and late �harges, �ii} ali
<br /> other sums then s�cured h�reby, and �iii} th� remaind�r, i�any, to �he p�rson or persons legally�ntitled

<br /> (c} Trus�ee may in �he manner prov�ded by law postpone sal�❑f all or any pvrtion of#he Proper�y.
<br /> Remedies Not Exclus�ve. Trustee and Lender, and each ❑f them, shalf be entitled ta enforce payment and
<br /> perf�rmance of any indehtedness or obfigat�ans secured by this Deed of Trus�and to exercis�all righ�s and powers
<br /> under this Deed of Trust, under the Gredi� Agreement, unde�any of the Relat�d Documents, or under any other
<br /> ag�eement or any laws now o� hereafter �n force; notwi�hstanding, same or a�� o� such indebtedness and
<br /> obligatians se�ured by this Deed of Trus�may now ar hereafter be otherwise secured, whether by mortgage, deed
<br /> a��rus�, pledge, Iien, assignment❑�otherwise. Neith�r the accep�ance of this Deed of Trust no��ts enforcement,
<br /> whether by cour# action or pu�suant �a �he pawer of sal� ar other po�nrers contain�d in �his D�ed af Trus�, sha�l
