ABJAL, LLC, a <br />Nebraska limited liability company, and Eakes, Inc., a Delaware corporation, certify as follows: <br />1. ABJAL, LLC and Eakes, Inc. entered into a Right of First Refusal to Purchase Real Estate (the <br />"Agreement "), whereby ABJAL, LLC agreed to grant Eakes, Inc. a right of first refusal to purchase real <br />property, more particularly described as the following: <br />Lots One (1), Two (2), Three (3), and Four (4), Block Sixty-one (61), all in City of Grand <br />Island, Hall County, Nebraska. <br />2. ABJAL, LLC's contact address is: ABJAL, LLC <br />c/o Benjamin D. Eakes <br />5330 Merrimac Avenue <br />Dallas, TX 75206 <br />3. Eakes, Inc.'s contact address is: Eakes, Inc. <br />Paul McKinney, Operations Manager <br />617 W. r Street <br />Grand Island, Nebraska, 68801 <br />4. Under the Agreement, Eakes, Inc. has a right of first refusal to purchase the real property <br />described above in paragraph 1, in accordance with certain terms and conditions of the Agreement. <br />5. This Memorandum describes only selected terms of the Agreement, and reference is made to the <br />full text of the Agreement for the full terms and conditions.
