Agreement made the 22nd day of March, 2001, between Richard L. Harbaugh and Mary
<br />C. Harbaugh, Husband and Wife, of 2609 Riverview Drive, Grand Island, Hall County,
<br />Nebraska, herein referred to as trustor, and Kearney State Bank & Trust Company, of P. O. Box
<br />1930, Kearney, County of Buffalo, State of Nebraska, herein referred to as beneficiary.
<br />The parties recite and declare that:
<br />a. Trustor executed a trust deed on July 24, 1995, in favor of beneficiary, which was

<br />recorded on May 13, 1996, in the office of the Register of Deeds , of ]XIMU County, State of
<br />Nebraska, as Document No. 96- 103672, covering the following described property:
<br />Lot Twenty -Seven (27), Morningside Acres Third Subdivision, in the City of Grand Island, Hail County,
<br />Nebraska.
<br />b. The above mentioned trust deed was given as security for a Loan, described in such
<br />trust deed, in the amount of One Hundred Fifteen Thousand and No /100 - -- ($115,000.00)
<br />Dollars, executed on July 24, 1995, by trustor in favor of beneficiary.
<br />c. Trustor desires to obtain a loan in the amount of One Hundred Sixty Five Thousand
<br />and No/ 100 ---- ($165,000.00)-------- from The Equitable Building and Loan Association, FSB, of
<br />P.O. Box 160, City of Grand Island, County of Hall, State of Nebraska, herein referred to as
<br />lender, but lender requires that such loan be secured by a trust deed that will be prior to the trust
<br />deed in favor of beneficiary.
<br />d. Beneficiary is willing to subordinate the lien of the trust deed in their favor insofar as
<br />it encumbers the above - described premises, to the trust deed made in favor of lender
<br />w
<br />in order that trustor may obtain nsuch loan from lender. Said Deed of Trust securing
<br />lender's lien was recorded on _1�1 3, P601 as Document No. 01Mi-03dRe
<br />in the Office of the Hall County Register of Deeds.
<br />For the reasons set forth above, and in consideration of the mutual covenants and
<br />promises of the parties hereto, trustor and beneficiary covenant and agree as follows:
