<br /> inspecti�ns and tests, at Trustor's expense, as Lender may deem appropriate to determine compliance af the
<br /> Property with �his section of the Deed of Trus�. Any inspe��ions vr tes�s made �y Lender shall be for Lender"s
<br /> purposes on�y and shall nvt he cans�rued to create any responsibili�y or liability on the part o� Lende�to Trustor or
<br /> tv any vther persvn. The representa�ions and warran�ies con�ained herein are �ased on Trustar's du� diligence €n
<br /> in�estigating the Property �vr Hazardvus 5ubs�an�es. Trustor hereby {1) releases and wai�es any future claims
<br /> aga�nst Lender for ind�mnity or contribution in the e�ent Trustor becames liable far ���anup or other cos�s under
<br /> any such laws; and ��y agrees to indemnify, defend, and ha[d harmless Lender against any and all claims, �osses,
<br /> liabilities, damages, penalties, and expenses which Lend�r may direct(y ar indirectly susta�n or suffer resul�ing from
<br /> a breach ofi this se�tion af the Deed af Trust ar as a consequence a� any use, generat�on, manu�acture, s�orage,
<br /> disposal, release ar�hreatened release occurring prior ta Trustor's ownership or interest�n the Property, whether or
<br /> not the same was or shvuld ha�� k���n known to Trustor. Th� pro�is�ons o� this s�ct�on ❑� the Deed of Trust,
<br /> including the obligation�a indemnify and defend, shall sur�i�e the payment o�the Indebtedness and the satisfaG�ion
<br /> and recvn�eyance of the lien of this D�ed of Trust and shall n�t b� a��ected by Lender's acquisition of any �n�erest �
<br /> in the P�ap�rty, whether by foreclosure or❑therwise.
<br /> Nuisancs, Waste. Trus�or shall not cause, conduct ar permit any nuisance nor commit, permit, or suffer any
<br /> stripping o� or waste an or �a �he Proper�y or any porti�n �f the Property. Without limiting the gene�al�ty af the
<br /> �oregoing, Trustor will not remo�e, ar grant to any o�her party the right t� rem��e, any �imber, mine�a�s �including
<br /> oil and gas�, coa�, c�ay, scoria, svil, gra�el or rock produc�s wi�hout�ender's prior wri�ten consent.
<br /> Remv�al o#lmprv�ements. Trustor shall nat demolish or remo�e any Impro�ements from�he Real Prop�rty w€thout
<br /> Lender's prior written �onsent. As a candition to the remo�al of any Imprv�ements, Lender may require Trustor�o
<br /> make arrangements satis�actory to Lend�r ta rep�ace such lmpro�ements with lmpro�emen�s of at least equal
<br /> �a�us.
<br /> Lender's Righ�to Enter. Lender and Lender's agents and representati�es may enfier upon the Real Property at a��
<br /> reasonable times �o attend to Lender's inter�sts and ta inspect the Real Property �or purposes vf Trustor's
<br /> comp��ance with the�erms and c�nditions af this Deed of Trust.
<br /> Compliance with Go�ernmen�ai Requirements. Trus�or shall pramp�ly ��mply with a(I �avus, ordinances, and
<br /> regulati�ns, now or hereaf�er in e�fect, o�F all go�ernmen�al auth�rities applicable to the use ❑r ❑ccupancy of the
<br /> Property, includ'€ng withaut limitation, �he Ameri�ans Wi�h Disabilities Act. Trus��r may c�ntest in good �raith any
<br /> such �aw, ordinanc�, or regulatian and withhold compliance during any proceeding, �ncluding appr�priat� appeals,
<br /> sv Ivng as Trustor has noti�ied Lender in writing prior to doing so and so long as, in Lender's sole opinion, Lender's
<br /> interes�s in the Property are not jeopardized. Lender may require Trustvr tv post adequate security or a su�ety
<br /> bond, reasonably satisfactory to Lender, to protect Lender's inte�est.
<br /> Du#y to Prvtecfi. Trustor agrees neith�r �o aband�n or lea�e unattended �he Property. Trustvr shall d❑ afl oth�r
<br /> acts, in addition to thvse acts set f�rth abQ�e in th(s section, which from�he chara�ter and use �fi the Proper�y are
<br /> reasanab�y necessary to pro��ct and pr�ser�e the Praperty.
<br /> DUE�N SALE-C�NSENT BY LENDER. Lender may, at Lender's op�ion, declare immediateiy due and payable all sums
<br /> secured �y this Deed of Trusfi upon the sale or transfer, withou� Lender's prior wri��en consent, of all or any part�f the
<br /> Real Proper�ty, ❑r any �nte�est in the Real Property. �1 "sale or transfer" means �he con�eyance of Reaf Praperty or any
<br /> righ�, ti�le or interest in �he Real Property; whether legal, beneficial or equita�le; whe�her �oluntary ar in�oluntary;
<br /> whether by outright sale, deed, insta��ment sale �ontra�t, land contract, contract �For deed, �easehold interest with a
<br /> �erm greater than three �3� years, lease-option cont�act, or by sale, assignment, �r ��ansfer of any beneficiaf interest in
<br /> or to any land trus� holding titie fi❑ the Reai Property, or by any other methad of con��yance of an in�eres� in the Rea�
<br /> Property. Howe�er, this aption shall not be exercised hy L�nd�r i� such exercise is prohib�ted by federal �aw ar by
<br /> Nebraska faw.
<br /> TAXES AND LIENS. The �ollowing pro�isivns rela�ing �� the �axes and liens on �he Proper�y are part a� th�s ❑eed af
<br /> Trust:
<br /> Payment. Trustor shall pay when due {and in aii e�ents prior to delinquency� afl�axes, spec+al�ax�s, assessmen�s,
<br /> charg�s �including water and sewery, �ines and impositions le�ied against or on ac�ounfi o��he P�operty, and shall
<br /> pay when due a!! claims for work done �n or for ser�ices rendered or material furnished t❑ the Praperty. Trustvr
<br /> shall maintain the Property f�ee �f a!! li�ns ha�irag priority o�er or equal to the interest of Lender under this Deed of
<br /> Trust, except f�r the lien fl� taxes and assessments not due and except as otherwise pro�ided in this Deed n�
<br /> Trust.
<br /> Right to Cvntest. Trus�or may withhold payment of any tax, assessment, or ciaim in connect€on with a good fai�h
<br /> dispute oWer th� ohliga�ion to pay, so ivng as Lender's �nt�res��n the Proper�y is not jeopardized. I�a lien arises or
<br /> is #iled as a result o� nanpayment, Trustor shall within. �if�een ���� days af�er th� �ien arises ❑r, i� a lien is filed,
<br /> within fifteen {15� days a�ter Trustor has notice of th� filing, secure the discharge of �he lien, ar if requested by
<br /> Lender, deposit with L�nd��cash or a sufficient corporate surety bond or other security sa�isfac�ory t❑ Lend�r in an
<br /> amount sufficient to d�scharge the �i�n p�us any casts and attorneys' fees, or�ther �harges that�ould a�crue as a
<br /> result❑f a #vre�losure or sa�e under the �ien. In any cont�st, Trustor sha(f de�end its���and Lender and shall satisfy
<br /> any ad�erse judgmen�befvre enforcement agains�the Prvperty. Trustor shall name Lend�r as an add�t�anal obligee
<br /> under any surety bond furnished in the con�est prace�dings.
<br /> E�idencs vf Payment. Trusto� shall upon d�mand furnish ta Lender satisfa�tory e�idence �f payment of the �axes
<br /> ❑r assessments and sha�l authoriz� �h� appropriate go�ernmental vf�icial to deli�er ta Lender at any time a written
<br /> statemen�vf�he�axes and assessments a�ainst the Praperty.
<br /> Nvtice nf Construc�ion. Trus�or shall notify Lender at least fifte�n �15y days before any wo�k �s commenced, any
<br /> ser��ces are furnished, or any ma�erials are suppfied tv the Property, if any mechanic's I��n, materialmen's lien, or
<br /> other �ien cauld be asserted on ac�oun# of the work, s�r�ices, or ma�erials. Trustor will upon re�u�st of Lender
<br /> �urnish to Lender ad�ance assurances sa�isfa�tary �v �ender �ha� Trustor can and will pay the C05t af such
<br /> impro�ements.
<br /> PR�PERTY DAMAGE INSURANCE. Th� foll�wing pro�isians relating to insuring the Property are a part of this Deed vf
<br /> Trust.
<br /> Main#�nance vf �nsurance, Trustor shaff procure and maintain poiicies o� �ire insurance with standard ex�ended
<br /> co�era�e endorsemen�s on a replacement �asis fi�r the full insurable �alue co�ering a�� �mpro�ements on the Real
<br /> Pr�perty in an amount sufficien� to a�oid appfication af any coinsurance �lause, and with a standard mor�gagee
<br /> clause in fa�ar of Lender. Trus�or shall also procure and maintain c�mprehensi�e genera( liab��ity insuran�e in such
<br /> ca�erage amounts as Lender may reque�� with Trustee and Lender bein� named as addit€onal insureds in such
<br /> �iability insuran�e poiicies. Additionally,,:�Trus�ar shall main�ain such other insurance, including but not limited �o
<br /> hazard, business �nterruptian, and boiler insurance, as Lender may reas�nably require. Poiicies sha�� be wri�ten in
<br /> �arm, amounts, co�erages and basis reasonably accep�able �o Lender and issued by a campany or companies
<br /> reasonabfy acceptable ta Lender. Trustor, upc�n �eques� af Lender, will deli�er to Lender from �ime to time the
